Cedros Avenue Solana Beach, CA 92075 SUBJECT: PRE 2023-0003 (DEV2023-0026) -DEVRIES BEACH ACCESS RAILING REPLACEMENT APN: 210-120-27, -31 Thank you for submitting a preliminary review to replace an existing steel railing in-kind for a stairway along a blufftop which provides beach access for an existing single-family home located at 5305 Carlsbad Boulevard, APNs 210-120-27-00 and 210-120-31-00. Based on correspondence with you, no mechanized equipment will be used and the work will be completed utilizing hand-held tools (i.e., drill and saw to remove railing). In addition, no new footings will be needed (i.e., no proposed intrusion into blufftop) and the concrete stairway along the blufftop will not be replaced. In response to your application, the Planning Division has prepared this comment letter. Please note that the purpose of a preliminary review is to provide you with direction and comments on the overall concept of your project. This preliminary review does not represent an in-depth analysis of your project. It is intended to give you feedback on critical issues based upon the information provided in your submittal. This review is based upon the plans, policies, and standards in effect as of the date of this review. Please be aware that at the time of a formal application submittal, new plans, policies, and standards may be in effect and additional issues of concern may be raised through a more specific and detailed review. Planning: General 1. General Pli;m and zoning designations for the property are as follows: a. General Plan: R-4/O5, Residential 0-4 dwelling units per acre/Open Space b. Zoning: R-1/OS, One-Family Residential/Open Space c. Coastal Zone: The project site is located within the Coastal Zone and is subject to the Mello II Segment of the Local Coastal Program (LCP). The LCP Land Use and Zoning are consistent with the City's General Plan Land Use and Zoning for the site. The property is located within the California Coastal Commission's Appeals Jurisdiction. d. Overlay Zones. Pursuant to Carlsbad Municipal Code (CMC) Section 21.204.030, steps and stairways providing access from the top of the bluff to the beach are permitted beach uses. Based on aerial photographs submitted with the Preliminary Review application, the private stairway and railing provide beach access for a single-family home and predate the California Coastal Act, which was established in 1976 and regulates development in the coastal zone. 3. Pursuant to CMC Section 21.201.060.B.10, the proposal to replace the existing steel railing along a blufftop stairway with a new steel railing without the use of mechanized equipment (i.e. only manual tools will be used) and without modifications to the blufftop is a repair or maintenance activity that is exempt from the requirement of a Coastal Development Permit. Please be advised this determination has been made based on the information provided to staff via email correspondence and the Preliminary Review application. Specifically, pursuant to CMC Section 21.201.070.B.3, a coastal development permit is not required.for repair and maintenance activities within twenty feet of coastal waters or along the blufftop as long as none of the following is required: a. The placement or removal, whether temporary or permanent, of rip-rap, rocks, sand or other beach materials or any other forms of solid materials; b. The presence, whether temporary or permanent, of mechanized equipment or construction materials. 4. The Land Development Engineering Division did not have any comments on the subject Preliminary Review. All necessary application forms, submittal requirements, and fee information are available at the Planning counter located in the Faraday Building at 1635 Faraday Avenue or online at https:ljwww.carlsbadca.gov/departments/community-development/planning. You may also access the General Plan Land Use Element and the Zoning Ordinance online at the website address shown. Please review all information carefully before submitting.
