HomeMy WebLinkAboutCD 2023-0002; PALOMAR AIRPORT ROAD CARWASH; Admin Decision LetterApril 3, 2023 Palomar Airport Partners LLC 1991 Palomar Airport Road Carlsbad CA 92011 SUBJECT: CD 2023-0002 (DEV2023-0028} -PALOMAR AIRPORT ROAD CARWASH ("city of Carlsbad BFILE COPY The City Planner has completed a review of your application for a Consistency Determination, CD 2023- 0002, (APN: 213-092-17-00) which is a modification to AMEND 2022-0006 (related permits include CUP 91-03(c)), a request to modify the approved exterior colors and fa!;ade elements of the carwash building. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. The proposed modifications include: • Modifying the approved colors of off-white and blue to earth-tone colors consisting of beige, off-white arid dark blue. • Further articulate north and south elevations with pop-outs. • Replace small windows on north elevation with pop outs. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the proposed revisions to the carwash building elevations maintains the overall design, quality and function of the project. No changes to the site plan are proposed. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the proposed revisions to the carwash building elevations maintains the overall design, quality and function of the project and complement the existing store building design. 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit in that no new land uses are proposed. 5) The proposed revision does not rearrange the major land uses within the development in that no additional uses are proposed and the project remains consistent with the carwash building approved under AMEND 2022-0006. Community Development Department Planning Division I 1635 Faraday Avenue Carlsbad, CA 92008-7314 I 442-339-2600 www.carlsbadca.gov · CD 2023-0002 (DEV2023-0028) -PALOMAR AIRPORT ROAD CARWASH March 29, 2023 Pa e 2 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that the minor site changes to accommodate the equipment remains consistent with development standards. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the modifications to the carwash building fafade will not result in any additional impacts to noise, air quality, average daily traffic or water quality and the site can be adequately served by all utilities and public services. BJ The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved as the proposed revisions to the carwash building elevations maintains the overall design, quality and function of the project and complement the existing store building design. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35.
