This memorandum provides an update to a previous Council Memorandum dated
February 9, 2023 (Attachment A), on the status of the Orion Center Project, Capital
Improvement Program {CIP) Project No. 3572 (project). The project will construct a
maintenance and operations facility that will house Public Works Branch and Parks &
Recreation Department staff at 2600 Orion Way.
Background
Over the past 30 years, the city's goal has been to collocate the following geographically
separate operations into one facility:
• Public Works Facilities Maintenance and Street and Storm Drain Maintenance located at
405 Oak Avenue
• Public Works Construction Management & Inspection located at 1635 Faraday Avenue
• Public Works Utilities/Carlsbad Municipal Water District (CMWD) located at 5950 El
Camino Real
• Parks Maintenance located at 1166 Carlsbad Village Drive
Collocation results in increased efficiency of operations, reduced environmental impacts to the
community, improved cross-training and collaboration, and opportunities to repurpose the
Oak, CMWD and Parks Maintenance properties.
On August 21, 2018, the City Council authorized an amendment to the agreement with the firm
preparing the bridging (or preliminary design) documents and appropriated additional project
funding. The City Council adopted Resolution No. 2018-156, appropriating an additional
$16.5 million for the Orion Center project, bringing the total appropriations up to $47.3 million.
This total included a budget of $38 million for construction, and the balance was allocated to
soft costs such as construction contingency and designer, consultant and staff fees.
In fiscal year 2020-21 and in accordance with Carlsbad Municipal Code Section 2.18.110 -
Appropriations for arts, the City Council authorized an appropriation of $500,000, or at least 1%
of the estimated total construction cost, for public art as aligned with the city's Arts in Public
Places document, for a total project appropriation of $47.8 million. The project's appropriation

sources include the Community Facilities District (CFD) #1 fund (72.2%) and utilities funds
(Water Capital Replacement, 13.9%; Sewer Replacement, 8.3% and Recycled Water, 5.6%).
CFD #1 Project Funding
In May 1991, the CFD #1 was established to fund construction of certain public facilities
generally described as a new library facility, a major addition to an existing library building, a
City Hall complex, and the addition of an office warehouse facility at the Public Safety Center. In
addition, funding for park improvements (Veterans Memorial Park) and other specific major
street and bridge improvements, many of which have been constructed, could also be funded
using the CFD #1 fund.
In addition to the Orion Center, the remaining projects eligible for CFD #1 funding include
construction of the City Hall replacement, Cole Library replacement and the new Veterans
Memorial Park.
Real estate opportunities
Construction of the Orion Center would also create financial opportunities by allowing for the
repurposing of three city facilities located at 405 Oak Avenue, 5950 El Camino Real and
1166 Carlsbad Village Drive. Public Works staff are coordinating with the Real Estate Division on
future opportunities with these properties and will report back to the City Council at a future
date.
Discussion
Since the last project update on February 9, 2023, the Conditional Use Permit (CUP),
CUP 2018-0022, application was completed, posted for public comment, and reviewed and
approved by the city's Planning Commission with Resolution Nos. 7474 and 7475 on
April 5, 2023. The Planning Commission voted 5-0-0-1 (one commissioner recused herself) to
approve the environmental document and CUP for the project. A copy of the Planning

Because of recent increases in construction materials and labor costs, due to inflation and
supply chain issues and since the last cost estimate was updated in 2018, staff commissioned a
consultant in March 2023 to update the construction cost estimate with the current scope of
work that was presented to and approved by the Planning Commission. The updated
construction cost estimate for the project is approximately $61 million, which is a 60% increase
to the previous and budgeted $38 million construction estimate.
Factors influencing this increase have been cited as:
•Consumer price index (CPI) going up 20% since 2018

• A greater level of project detail incorporated into the CUP technical studies, specifically
in relation to compliance with the Climate Action Plan and updated ordinances,
including vehicle miles traveled (VMT)
• Inflationary increases in construction materials nationwide
• Increases in contractor costs nationwide ranging from 10;9% to 20.8% since
November 2021, depending on the construction trade
Given the updated cost estimate for the Orion Center, the recent City Council decision to
construct a smaller replacement City Hall facility and maintain the Faraday Center, the plan to
develop Veterans Memorial Park, and the recent changes in telecommutingthat resulted from
the COVID-19 pandemic, staff will revisit the scope of the Orion Center project and return to
the City Council with a recommendation on the way forward prior to proceeding with the final
design process.

Backgroun d ·
Attachment A provides background information on this project. Since the last update on
July 21, 2022, project consultants continued to work on engineering-related site details and other
supporting documents for the conditional use permit (CUP) application. On January 27, 2023, the
CUP application and associated documents were completed, and the Mitigated Negative
Declaration (MND), as required under the California Environmental Quality Act (CEQA), was
drafted.
Discussion
Pursuant to CEQA, the city must publish a Notice of Intent with the local newspaper and State
Clearinghouse, announcing the public review period for the project and the MND. The public
review period started on January 27, 2023, and it will end on February 26, 2023. Following
public testimony, staff anticipate a tentative Planning Commission hearing in April 2023. This
date may change depending upon the number and content of the comments that are received
during public review.

Background
:Attachment A provid.es background information on t his project. Since the last update on
Jan. 20, 2022, project consultants have continued to work on-engineering-related sit e details and
other supporting docLJments for the conditional use permit (CUP) application. The consultants
submitted revised documents to address prior plan,-check comments in January and May 2022.
Staff provided Rian-check responses to those submittals in Febuiary and July 2022, respectively.
Specific items included the transportation demand managemen_t (TOM) plan, preliminary
hydrology study, updated sto_r:m water quality management plan, ston:n water det ention' basin
de.sign, square foot age on grading plans, cross section of the new retaining wall and other details.
Additionally, staff have updated their compreliensive time-based schedul.e for all drawings and
documents, including environmental documerits and technical studies, required as part of th·e
project's discretionary review process. Staff met with the consultant on July 18, 2022,.to discuss
their resubmittal and the way forward.
Discussion
The civil engineering site details affecting storm water treatment on site have been revised, and
an updated site plan has been prepared and were discussed with staff on July 18, 2022..
Additionally; environmental documents have been revised and updated. An updated set of
revised plans is scheduled to be resubmitted this week.
In addition to working toward finalizing· all CUP supporting documents, staff have been tracking
the progress of each supporting document'~ review in a time-based schedule leading up to a
. Planning Commission hearing date, which is anticipated to be in early 2023.
