Whereas no review of the conditions of the letter of preliminary approval was requested
by the appropriate date; and whereas the requirements of the California Environmental
Quality Act and the City of Carlsbad Environmental Protection Ordinance of 1973 relating
to the subject proposed parcel map have been examined by the Planning Director and
declared to have a non-sigruficant impact upon the environment; and whereas negative
findings delineated by Section 20.24.130 of the Ciirlsbad Municipal Code have not been
made; and whereas this minor subdivision is found to be in conformity with the General
Plan of the City of Carlsbad; therefore, a final decision has been made to approve the
subject tentative parcel map subject to the conditions set forth in the preliminary approval
letter.

PROPOSED MINOR SUBDMSION NO. 859
A preliminaiy decision has been made, p,muant to Section 20.24.120 cf :he CJty of Carlsbad
Municipal Code, to approve the tentative parcel map of the proposed minor subdivision subject to
the followmg conditions:
1. ni.e parcel map shall comply with the Land Use Planning Office memorandum for Minor
SubdiV1sion No. 859, dated April 5, 1991 (Attached Hereto).

The tentative parcel map approval shall expire two (2) years from the date of the letter
containing the final dec1s10n for tentative parcel map approval.
The developer shall provide the City with the reproducible 24" x 36' mylar copy of the
tentative parcel map as approved by the City Engineer. The tentative parcel map shall
reflect the conditions of approval by the City. The map copy shall be submitted to the City
Engineer prior to issuance of butlding pennits, improvement plans, or grading penruts
submittal, wluchever occurs first.
Unless a standard variance has been issued, no variance from City Standards is authorized
by vutue of approval of tlus tentative parcel map.
TI1e developer shall submit proof of a Ca!Jfomia State Coastal Comnussion permit prior to
parcel map approval
All required fees and deposits shall be paid prior to parcel map recordation.
Pnor to approval of the parcel map the developer shall pay and/ or enter into an agreement
with the City to pay any drainage area fees estabhshed as a result of the forthcoming Master
Drainage Plan Update.
8. The applicant ,hall pay park-in-lieu fees to the City prior to the approval of the parcel map
as rcqmred by Chapter 20.44 of the Carlsbad Municipal Code.
9. The subdivider shall be responsible to pay the recording fees for all agreements, easements
an.I documents required for this project.

The owner shall enter into lien contract for the future improvement of Hoover Street along
the subdivision frontage for a half street width of 30 feet prior to approval of the parce(
map. Improvements shall include but not be limited to paving, base, sidewalks, curbs and
gutters, medians, grading, clearing and grubbing, undergrounding or relocat1on of ut!lit!es,
sewer, water, fire hydrants or retarning walls.
This project is approved under the express condition that the applicant pay the additional
public facilities fee adopted by the City Council on July 28, 1987, and any development fees
established by the City Counctl pursuant to Ordinance No. 9791 or subsequent ordinance
adopted to implement a growth or development management system or public facilities
phasrng plan to fulfill the subdivider's agreement to pay the public facilities fee, a copy of
which IS on file with the City Clerk and is incorporated by this reference. If the fees are not
paid, this application will not be consistent with the General Plan and approval for this
project shall be void.
This project is approved upon the express condition that building permits will not be issued
for development of the subject property unless the City Engineer determines that sewer
facilities are available at the time of application for such sewer penruts and will connnue
to be available unt!l lime of occupancy. Tlus note shall be placed on the parcel map.
Five feet shall be dedicated by the developer along the subdivision frontage based on a
centerline to right-of-way width of 30 feet in conformance with City of Carlsbad Standards.
The offer shall be made by a Certificate on the Parcel Map. All land so ,ffered shall be
granted to the City free and dear of all hens and encumbrances and w,thout cost to the
City, Streets that are already public are not reqmred to be rededicated.
Prior to parcel map approval the developer shall record a covenant of easements for
drainage easements as shown on the tentative map. ni.e covenant of easements shall be
shown and recording rnformanon called out on the parcel map.
The owner of the subiect property shall execute a Hold Harmless Agreement regarding
drainage across the adjacent property prior to approval of the final map for this project.
The owner of the subject property shall execute a Hold Harmless Agreement regarding the
panhandle lot pnor to approval of the parcel map.
The City is in the process of revising the Grading Ordinance to include provisions for control
of grading within rnfill lot areas within the City. Tlus project must comply with all Grading
Ordmance requirements at time of grading pemut issuance including any new ordinance
prov,s1ons regarding the approval of grading on infill lots.
This project is located withrn the Agua Hedionda Lagoon Management plan. All
development design shall comply w,th the reqU1Iements of that plan.
The drainage system shall be dedgned to ensure that runoff resulting from a lO•year
frequency storm of a 6 hours or 24 hours duration under developed conditions, is equal to
or less than the runoff from a storm of the same frequency and duraaon under existing
developed conditions. Both 6 hour and 24 hour storm durations shall be analyzed to
deternune the detention basin capacities necessary to accomplish the desrred results.
Add1t1onal drainage easements and drainage structures shall be provided or installed prior
to the issuance of grading or bmlding permit as may be required by the City Engineer.
The applicant may request a review of the preliminary conditions within ten (to: days of
the date of this apprcva!. The request must be submitted rn writing to the City Engu,~er
in accordance with Section 20.24.120 through 140 of the Carlsbad Muruc1pal Code.

Applicant: Bruce Pahl
The Planning Department has completed a review of the application for a two lot minor
subdivision, creating a panhandle lot located at 1250 Hoover Street in the R~l-15,000
zone. After careful consideration of the circumstances surrounding this request, the
Pl.,nning Director has detemuned that the findings required for approvmg a lot split
creating one or more panhandle lots, can be m.ide, and therefore, recommends APPROVAL
of this request based on the findings am! conditions:
Findings:
1) The properties cannot be served adequately with a public street without panhandle
lots due to unfavorable conditions resulting form the lot's configuration.
2) Subdivision with panhandle lots will not preclude or adversely affect the ability to
provide full public street access to other properties within the same block.
3) The proposed subdivision is consistent with all elements of tne City's General Plan,
including the land use element which designates this site for Residentml Low-
Medium density residential development at J 2 du/acre.
4) The proposed project will not result in adverse environmental impacts, and it has
been found to be exempt from the California Environmental Qu.11ity Act per Section
15305, which specific.1lly exempts minor subdivisions and p.1nhandle lot
subdivisions 1n developed areas and in the R-1 zone.
5) The project is consistent with all City public facihty policies and ordinilnces, and
with Title 21 of the City's Municipal Code.
Conditions:
1) Approval is granted for MS-859 as shown on Exhibit "A", dated April 4, 1991,
incorporated by reference and on file in the Planning Department. Development
shull occur subst.mnally as shown unless otherwise noted m these cond1t10ns.

The panhandle lots shall each have three non-tandem parking spaces with an
approach not less than twenty-four feet in length with a proper turnaround area to
permit complete turnaround for a forward access to the street. Said parking a~d
tum3round shall be subject to the approval of the City Engineer.
Structures permitted in the access portion of the lots shall be limited to mailboxes,
fences, trash en~losures, landscape containers, and nameplates. Except for
mailboxes, the st·•,c,,r~s :1-i 111 not be greater than fc,ty-two inches in height 1f
locQtc<l within twenty feet ot the street property lme or greater than ~ix feet m
height beyond tlus point.
Prior to final map approval, the property owners shall enter into an agreement to
hold the City, or any other public service agency harmless from liability for any
d:1mage to the driveway when being used to perform a public service subject to
Planning Direcror and City Attorney approval.
All lots shall have a minimum depth of ninety feet.
The buildable portions of the panhandle lots shall be all portions of the lots that
have a width greater than thirty-five feet.
The front yard of parcel 2 is defined as a line parallel to Hoover Street at the
southern portion of the lot.
