Tl1,:: applicant may request a review of the preliminary conditions within ten (10) days of the date of this approval. The request must be submitted in writing to the City Enginrer in accord.ince with Section 20 )4.120 through 140 of the Carlsbad Municipal Code. 2. 3. 4. s. 6. 7. The tentative parcel map approval shall expire two (2) years from the date of the letter containing the final decision for tentative parcel map approval. The parcel map shall comply with the Land Use Planning Office memorandum for Minor Subdivision No. 866, dated July 1, 1991. The developer shall provide the City with the reproducible 24" x 36" mylar copy of the tentative parcel map .is approved by the City Engineer. The tentative pare el map shall refitct the conditions of approval by the City. The map copy shall be submitted to the;-City Engin<:"er prior to issuance of building permits, improvrment plans, or grading permits submittal, whichever occurs first. Unless a standard variance has been issued, no variance from City Stand,,rds is authorized by virtue of approval of this tentative parcel map. After careful consideration of the cncumstances surrounding this request, the Planning Director has detennined that the findmgs required for approvmg a lot split creating one or more panhandle lots, can be made, and therefore, recommends APPROVAL of this request based on the findmgs and conditions: Findings: 1) 2) 3) 4) 5) 6) 7) The properties cannot be seived adequately with a public street without panhandle Jots due to unfavorable condiuons resulting from the lot's configuration. Subdivision with panhandle lots will not preclude or adverse',, affect the ability to provide full public street access to other properties within the same ~ lock. The project will prov,de sufficient add1, ,anal public fac1hties for the density in excess of the co .. trol pomt to ensure that the adequacy of the City's public facilities plans will not be adversely imp,icted. The subdivision proposes 4 du/acre which exceeds the Growth Management Control Point of 3.2 du/acre However, there have been sufficient developments approved in the quadrant at densities below the control point to cover the units in the project above the control point so the approvJ.l will not result in exceeding the quadra.nt llirut. When the Northwest Quadrant was evaluated for projected buildout allowed, the property descnbed as Lot 9, Block G of l '.a.p No. 2152 was assessed to potenually contain 5 lots as the R-1-7500 Zone penmts. Because this parcel was prederenmned to allow 5 parcels, the four proposed parcels are mcluded in the hm1t of 5,844 future umts set by Proposition E in the Northwe~t Quadrnnt 'Iherefore, the devleopment will not result in exceeding the quadrant hm1t. The proposed project will not result in adverse environmental impacts, and 1t has been found to be exempt trom the Cahfornia Env,ronmenLJ.I Quality Act per Sectlon 15315, which specifically exempts mmor subJivisions and panr,. mile lot subd1vmons in developed areas and m the R-1 zone. Prior to approval of r 1e parcel map the developer shall pay and/or enter into an agreement with the City to I ay any drainage area fees established as a result of the forthcoming Master Drainage Plan Update. 10. The applicant shall pay park-in-lieu fees to the City prior to the approval of the parcel map as required by Chapter 20 44 of the Carlsbad Municipal Code. 11. The subdivider shall be responsible to pay the recording fees for all agreements, easements and documents required for this project, 12. The owner of the subj,·ct property shall execute a Hold Harmless Agreement regarding the panhandle lot prior to approval of the parcel map. 13. This project is approved upon the express condition that building permits will not be issued for development of the subject property unle'ss the City Fngineer determines that sewer facilities are available at the time J application for su~h sewer pernuts and will co .. tinue to be available until time of occupancy. Sufficient right-of-way along the subdivision frontage needed to complete the cul-de- sac bulb on Jeanne Place shall be dedicated by the owner in conformance with City of Carlsbad st.indards and to the satisfaction of the City Engineer. The offer of dedication shall be made by a Certificate on the Parcel Map. All land so offered shall be granted to the City free and clear of the all liens and encumbrances and without cost to the City. Streets that are already public are not required to be rededicated. 17. The conceptual driveway layouts shown or , he Tentative Map are not specifically approved. Prior to approval of the improvement plans the driv, ·ways shall be desii.,,1ed to the City Engineer's satisfaction. 18. The owner of the subject pr"perty shall execute a Hold Harmless Agreement regarding drainage across ,he adjacent property prior to approval of the final map for this project.
