PROPOSIID MINOR SUDDMSION NO. 867, CP 91-06
A preliminary decision has been made, pursuant to Section 20.24.120 of the Ciry of
Carlsbad Municipal Code, to approve the tentative parcel map of the proposed minor
subdivision subject to the following conditions:
l. The applicant may request a review of the preliminary conditions within ten (10)
days of the dare of this approval. 1be request must be submi1ted in writing to the
City Engineer in accordance with Section 20.24.120 through 140 of the Carlsbad
Municipal Code.
2. The parcel map shall comply with the Land Use Planning Office memorandum for
Minor Subdivision No. 867/CP 91-06, dated January 9, 1992. (Auached hereto)
3. The tentative parcel map approval shall expire two (2) years from the dete of the
lener containing the final decision for tentative parcel map approval.
4. The applicant shall provide the City with the approved tentative parcel map. The
map shall be m scale on a reproducible 24" x 36" xerox or photo mylar. The
tentative parcel map shall rellcct the conditions of approval by the City. The
reproducible shall be submillcd to the City En!l'neer, reviewed and signed by the
City's project engineer and project planner prior 10 submittal of the building plans,
final map, improvement or grading plans, whichever occurs first.
5. Unless a standard variance has been issued, no variance from City Standards is
authorized by virtue of approval of this tentative parcel map.
6. All required fees and deposits shall be paid prior to percel map recordation.
The applicant shall defend, indemnify and hold harmless the City and its agents,
officers, and employees from any claim, action or proceeding against the City or its
agents, officers, or employees to anack, set aside, void or null an approval of the
City, the Plmrning Commission or City Engineer which has been brought again~! the
City within the time period provided for by Section 66499.37 of the Subdivision
Map Act.

8. Prior to approval of the parcel map the developer shall pay and/or enter into an
agreement with the Ciry to pay any drainage area fees established as a result of the
forthcoming Master Drainage Plan Update.
9. The applicant shall pay park-in-lieu fees to the Ciry prior 10 the approval of the
parcel map as required by Chapter 20.44 of the Carl•b11d Municipal Co4o,.
10. The subdivider shall be re•ponsible to pay the recording fee• for all agreements,
easements and documents required for this project.
11. The owner shall enter into a lien contract for future sidewalk construction along the
subdivision boundary fronting on Alga Road prior to approval of the parcel map.
Improvements shall _include bu~ not be limited to sidewalk construction together
with grading, cleanng, grubbing, slope cuts and/or retaining walls and any
nece1>Sary relocation of utilities.
12. The develope~ shall comply with all the rules, regulations and design requirements
of the respective sewer and water agencies regarding service5 to the project.
13. The developer shall be responsible for coordination with S.D.G.&E., Pacific
Telephone, and Cable 1V authorities.
14. Prior to approval of the parcel map the owner shall give written consent to the
annexarion of the area shown within the boundaries of the site plan into the
existing City of Carlsbad Street Lighting and Landscaping District No. l. 1be form
shall be provided by the City during the p!ancheck process.

The City has completed a review of the ab.ave referenced application for a two-unit condominium
conversion for the duplex located at 2628 -2630 Luciernaga Street.
It i<_ the _Planning Direc.toI's det~rmination th.a~. based 011 the anached findings and conditions, the
p,oiect is cons1Sten1 with the City's condomuuum regulations (Chapter 21.45) and with all other
applicable City o_rdinances a.nd. policies. ;urther, the project has been found to be categorically
exempt from environmental review accordrng to Section 15301 (k) of the California Environmental
Quality Act and a Notice of Exemption was filed on December 19, 1991.
This letter, induding the listed findings a.nd conditions, constitutes approval of CP 91-6.
Findings:
1. The granting of this permit will not adversely affect, ,u,.d will be consistent with the zone
code, the general plan, applicable specific plans, master plans, and all adopted pl'ans of the
city and other governmental agencies.
2. The P~~posed_ use ~t the P";fflcular location is necessary and desirable to provide a service
or facility which will conmbute to the long-renn general well-being of the neighborhood
and the community.
3. The use _will_ not be ~~ri:rmental to ?'e health, safety, or general welfare of persons residing
or working III the VlCllllty, or 11\Junous to propeny or improvements in the vicinity.
4. This existing structure has a 32 foot setback from Alga Road where a 40 foot setback is
required, however, the proposed condominium conversion meets aU of the minimum
development standards set forth in Section 21.45.090 because AV 91-14 has been approved
for this reduced setback.
s. The proposed condominium conversion meets aU other design criteria set forth in Section
21.45.080 and has been designed in accordance with the concepts contained in the design
guidelines manual.

6. T.he project is designed to be sensitive to and blend in with the natural topography of the
sue.
7. The projeds design and the density of the developed portion of the site is eompatl'ble with
su~oundrng development and does not create a dishannonious or disruptive element to the
neighborhood.
8. The_ project's circulation system is designed to be efficient and weU integrated with the
project and does not dominate the project.
Conditions:
1. Approval i< granted for CP 91·6 as shown on Exhibit A dated December 19 1991 on file in
the Planning Department and incorporated herein by referenre. '
2. A copy of the final condominium conversion site plan, incorporating all conditions of
approval, shall be submitted to and approved by the Planning Director prior to final map
approval of MS 867.
3. All conditions of MS 867 are incoeporated herein by reference and shall be complied with
in their entirety.
4. U~ess o.therwise stated herein, this condominium project shall comply with all applicable
City ordrnances and reqwrements.
5. The dope area of the rear yard shall be preserved as an open space/non-building area
easement.
Please note that tlus approval letter and the conditions herein supersedes our previous approval
letter dated January 3, 1992.
