The preliminary conditions are: Nole: Unless specifically slated in the condition, all of the following conditions, upon the approval of this tentative parcel map, must be met prlor to approval of a final parcel map, building permit, or grading permit whichever is first. General /. Prior lo issuance of any building permit, Developer shall comply with the requirements of the City's anti-graffiti program for wall treatments if and when such a program is formally established by the City. 2. Developer shall submit la the City Engineer, a reproducible 24' x J67 photo mjlar of the /en/alive parcel map reflecting the conditions approved by the final decision making body (including any applicable Coastal Commission approvals). The reproducible shall be submitted to the City Engineer, reviewed and, if acceptable, signed by the City's project engineer and project planner prior to submittal of the bwldinq plans, fi'nal map, improvement or gradt'nq plans, whichever occurs first. J. Unless a standards variance has been issued, no variance from City Standards is authorized by virtue of approval of thi's tentative parcel map, 4. Developer shall and does hereby agree la indemnify, pro/eel, defend and hold harmless the City of Carlsbad, its Council members, agents, officers, and representatives, from and aqainst any and all !iab1llties, losses, damages, demands, claim and costs, inc!udinq court costs and attorney's fees Incurred by the City arising, directly or indirectly, from (a) Clty's approval and"issuance of th/S tentative parcel map, (b} City's approval or 1'ssuance of any permit or action, whether discretionary or non- discretlonary, in connect/On with the use contemplated herein, including an actiOn //led within the time period specified in Government Code SectiOn 66499.37 and (c} Developer's installation and operation of /he facility permitted hereby, including without limitation, any and all liab17ilies arising from the emission by the facility of e/ecfromagnet/c fields or other energy waves or emissions. 5. Developer is required to pay all required fees and deposl[s prior lo approval of the final parcel map. 9. Developer shall comply with all applicable provisions of federal, state, and local laws and regulations 1'n effect at the time building permits ore issued. 10. If any condition for construction of any public faCJ7ities, or payment of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project are challenged, /his approval shall be suspended as provided in Government Code Section 66020. If any such condition is determined to be invalid, this approval shall be invalid unless the City Engineer determines that this Project without this condition complies with the requirements of the law, II. Developer shall provide proof lo the Director from the Carlsbad Unified School District Iha/ /his project has satisfied its obliqatlon to provide school facilities. 12. This project shall comply with all conditions and mitiqation measures which are required as port of Zone I Local Facilities Management Plan and any amendments made to that Plan prior to issuance of building permits. IJ. Developer shall pay /he citywide Public Facilities Fee imposed by City Council Policy /I 7, /he License Tax on new construe/ion imposed by Carlsbad Municipal Code Section 5.09.0JO and CFO /1 special tax (if applicable), subject to any credits authorized by Carlsbad Municipal Code Section 5.09.040. Developer shall also pay any applicable Local Facilities Management Plan fee for Zone I, pursuant lo Chop/er 21.9. All such laxes/fees shall be paid al issuance of building permits. If /he laxes/fees are not paid, this approval will not be consistent with /he General Plan and shall become void 14. Developer shall display a current Zoning and Land Use Map, or an al/erna/ive, suitable lo /he Planniflg Director, in the soles office at all times. All sales maps that ore distributed or made available to the public shall include but not be limited to trails, future and existing schools, parks, and streets. 15. Developer shall post a sign in the sales office in a prominent location that discloses which special districts and school district provide service to the project. Said sign shall remain posted unbl ALL of the units ore sold. 16. Developer shall pay lo the City an inc/usionary housing in-lieu fee as an individual fee on a per market rate per dwelling unit basis in the amount in effect al the lime, as established by City Council Resolution from time to time. Fees/Agreements 17. Developer is required to pay all required fees and deposits prior to approval of the final parcel map. 18. Developer shall pay the Local Drainage Area Fee prior to approval of the final parcel map. 19. Developer shall pay pork-in-lieu fees to the City prior to approval of the final parcel map as required by Chapter 20.44 of the Carlsbad Municipal Code. 20. Developer shall cause property owner to execute and submit to the City Engineer for recordation the City's standard form Drainage Hold Harmless Agreement regarding drainage across the adjacent properly. 21. Prior to approval of any grading or building permits for this project, Developer shall cause Owner to give written consent to the City Engineer to the annexation of the area shown within the boundaries of the subdivision into the existing City of Carlsbad Street Li[lhting and Landscapiflg District No, !, on a form provided by the City Engineer. Grading 22. Prior to hauling dlrt or construction moterlals to or from any proposed construction site within this project, Developer shall apply for and obtain approval from, the City Engineer for the proposed haul route. 23. Based upon a review of the proposed grading and the grading quantities shown on the /en/alive parcel map, a grading permit for this project is requ,red Developer shall apply for and obtain a grading permit from the City Engineer. A Grading Permit cannot be issued until the final parcel map hos been recorded for /his project, tmorovements/Oedicotions 24. Developer shall comply with the City's requirements of the National Pollutant Discharge Elimination System (NPDES) permit Developer shall provide improvements constructed pursuant to best management practices as referenced in the ,,Ca//Yomia Storm Water Best Manaqement Practices Handbook" to reduce surface pollutants to an acceptable level prior to diScharge to sensitive areas. Plans for such improvements shall be submitted lo and subject to the approval of the City Engineer. Said plans shall include, but not be limited to notifyi'ng prospective owners and tenants of the following: A. All owners and tenants shall coordinate efforts to establish or work with established disposal proqrams to remove and properly dt'spose of toxic and hazardous waste products. 8. Toxic chemicals or hydrocarbon compounds such as gasoline, motor 01!, antifreeze, solvents, paints, paint thinners, wood preservatives, and other such fluids shall not be discharged into any street, public or private, or into storm drain or storm water conveyance systems. Use and disposal of pest/ck/es, funglcides, herbicides, insecticides, ferl!llzers and other such chemical treatments shall meet Federal, Stale, County and City requ,remen/s as prescribed in their respective con/a,ners. C. Best Manaqement Practices shall be used to eliminate or reduce surface pollutants when planning any chanqes to the landscaping and surface iinprovements. 25. Pri'or to issuance of buildinq permits, Developer shall install separate sewer services to each lot proposed by this tentative parcel map. Building permits will not be issued for development of the subject properly unless the appropriate agency determines that sewer and water fac,lities are avOJlable. Pri'or to approval of improvement plans or final parcel map, Developer shall meet with the Fire Marshal to determine if fire protection measures (fire flows, fire hydrant locations, building spnnklers) are required to serve the project. Fire hydrants, if proposed, shall be considered pub/le improvements and shall be served by public water mains to the satisfaction of the District Engineer. 29. DeWJloper shall install a combination meter to serve both potable and fire flow demands required for Lot 2 (panhandle fol) to the satisfaction of /he District Engineer. Developer shall hs/oll the meter and approved backflow preventer in a location that is not subjected to damage from vehicles. JO. Prior lo issuance of building permits, Developer shall pay all fees, deposits, and charges for connection to public facilities. Developer shall pay the San Diego Countv Water Authority capacity charqe{s) prior lo issuance of Building Permits. 31. The tentative parcel map shall expire twenty-four (24) months from the dale of the letter containinq the fl'nal decision for tentative parcel map approval. JJ. Developer shall exercise special core during the construction phase of this project to prevent offsite siltation. Plantinq and erosion control shall be provided in accordance with Carlsbad Municipal Code Chapter 15. 16 (the Grading Ordinance} to the satisfoc/ion of the City Engineer. The applicant may request a review of these preliminary conditions within ten (10) days of the dale of this preliminary approval. The request must be submitted in writing to the City Engineer in accordance with Sec/ion 20.24.120 through 140 of the Carlsbad Municipal Code. The City Enqineer has reviewed each of the exactiOns imposed on the Developer contoli'Jed 1'n the conditions of approval and hereby finds that the exactions are imposed lo mitigate impacts caused or reasonably related to this project, and the extent and degree of /he exactions is in rough proportionality lo /he impact caused by the project.
