HomeMy WebLinkAboutMS 851; CHESTNUT PARTNERS; Tentative Map ExhibitPllUPOSED MINOR SUBDIVISION NO. 851 A preliminary decision has been made, pursuant to Section 20.24.120 of the ~ity of Carlsbad Municipal Code, to approve the cenrative parcel map of the proposed minor subdivision subject to t.he following conditions: 1. ·n1e pared map shall comply with the Land Use PlarU1..ing Office memorandum for Minor Subdivision No. MS 851, dated February 27, 1991 (Attached Hereto). 2, 3, 4. 5, 6, 7, 8. 9. IO, 12, lJ, 14. I 5. 16, 17. 18, 19. 20, The tentative parcel map approval shall expire t½'O (2) years from the dare of the letter containing the final decision for tentative parcel map approval. The developer shall provided the City with the to scale reproducible 24~ x 36rt xerox or pholO mylar copy of rhe temative parcel map as approved by the City Engineer. The tentative parcel map shall reflect the conditions of approval by the Ciry. The map copy shall be submiued to the City Engineer prior to issuance of building permits, improvement plans, or grading pennits submittal, whichever occurs first. Unless a standard variance has been issued, no variance from Ciry Standards is aut..horized by vi.rrue of approval of this Lenrative parcel map. The developer shall defend, indemnity and hold hamlless the City and its agents, officers, and employees from any claim, action or proceeding against the City or its agents, officers, or employees to attack, set aside, void or null an approval of the City, tl1e Planning Com- mission or City Engineer which has been brought against the Ciry within the time period provided for by Section 66499.37 of the subdivision map act. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the findings required for approving a lot split creating one or more panhandle lots, can be made, and therefore, recommends APPROVAL of this request based on rhe findings and conditions: Findings: 1) 2) 3) 4) 5) The properties cannot be served adequately with a public street without panhandle lots due to WUavorable conditions resulting form the lot's configuration. Subdivision with panhandle lots will not preclude or adversely affect the ability to provide full public street access to other properties within the same block. The proposed subdivision is consistent with all elements of the City's General Plan, including the land use element which designates this site for low medium density. The land use element of the general plan provides the opportunity for a 25% increase m density to proposed subdivisim1S which create lots meeting the underlying R-1 zoning requirements. this subdivision meets all underlying zoning requirements and is compatible with surrounding development. The proposed project will not result ln adverse environmental impacts, and it has been found to be exempr from the California Environmental Quality Act per Section 15305, which specifically exempts minor subdivisions and panhandle lot subdivisions in developed areas and in the R-1 zone, The project is consistent with all City public facility policies and ordinances, and with Title 21 of the City's Municipal Code, Conditions: 1) Approval is granted for MS-851 as shown on Exhibit" A", dated rebruary 27, 1991, ,ncorporated by reference and on file en the Planning Department. Development shaU occur substantially as shown unless otherwise noted in these conditions. 2) The panhandle lots shall each have three non-tandem parking spaces with an approach nut less than twenty-four feet in length with a proper turnaround area to permit complere turnaround for a forward access to the street. Said parking and turnaround shall be subject to the approval of the City Engineer. 3) Structures permitted in the access portion of the lots shall be Ii.mired to m.-1ilboxes, fences, trash enclosures, landscape containers, and nameplates. Except for mailboxes, the structures shall not be greater than forty-two inches in height if located wilhin tvvenry feet of the street property line or greater than six feet in hecght beyond this point. 4) Prior to final map approval, the property owners shall enter into an agreement to hold the City or any other public service agency harmless from liability for any damage to the driveway when being used to perform a public service subject to ·Planning Director and City Attorney approval. 5) All lots shall have a minimum depth of ninety feet. 6) 7) The buildable portions or the panhandle lots shall be all portions of the lots that have width of greater than thirty•five feet. The front yard of lots 1 and 2 is defined as a line parallel with Chesrnut Avenue and at the southerly property line of lots 1 and 2.
