Buccola Buccola Engineering Inc. 3142 Vista Way, Suite 301 Oceanside, CA 92054 PROPOSED MINOR SUBDMSION NO. 863 A preliminary decision has been made, pursuant to Section 20.24.120 of the City of Carlsbad Municipal Code, to approve the tentative parcel map of the proposed minor subdivision subject to the fo ll owing conditions: 1. The tentative parcel map approval shall expire two (2) years from the date of the letter containing the final decision for tentative parcel map approval. 2. 3. 4. 5. 6. The developer shall provide the City with the reproducible 24" x 36" mylar copy of the tentative parcel map as approved by the City Engineer. The tentative parcel map shall reflect the conditions of approval by the City. The map copy shall be submitted to the City Engineer prior to issuance of building permits, improvement plans, or grading permits submittal, whichever occurs first. Unl ess a standard variance has been issued, no variance from City Standards is authorized hy virtue of apµroval of this tentative parcel map. The developer shall submit proof cif a California State Coastal Commission permit prior to parcel map approval. All required fees and deposits shall be paid prior to parcel map recordation. Prior to approval of the parcel map the developer shall pay and/or enter into an agreement with the City to pay any drainage area fees established as a result of the forthcoming Master Drainage Plan Update. 7. The applicant shall pay park-in-lieu fees to the City prior to the approval of the parcel map as required by Chapter 20.44 of the Carlsbad Municipal Code. 8. The subdivider shall be responsible to pay the recording fees for all agreements, easements and documents required for this project. 10. This project is approved under the express condition that the applicant pay the additional public facilities fee adopted by the City Council on July 28, 1987, and any development fees established by the City Council pursuant to Ordinance No. 9791 or subsequent ordinance adopted to implement a growth or development management system or publi c facilities phasing plan to fulfill the subdivider's agreement to pay the public facilities fee, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are nor paid, this application will not be consistent with the General Plan and approval for this project shall be void. 11. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the parcel map. 12. The owner shall enter into lien contract for the future improvement of Date Avenue along the subdivision frontage for a half street width of 28 feet prior to approval of the parcel map. Improvements shall include but not be limited to paving, base, sidewalks, curbs and gutters, grading, clearing and grubbing, undergrounding or relocation of utilities, sewer, water, fire hydrants or retaining walls. 13. Three feet shall be dedicated by the developer along the subdivision frontage based on a centerline to right-of-way width of 28 feet in conformance with City of Carlsbad Stand~:ds. The offer shall be made by a Certificate on the Parcel Map. All land so offered shall be granted to the City free and clear of all liens and encumbrances and without cost to the City. Streets that are already public are not required to be rededicated. 14. Prior to approval of the parcel map all existing structures on the site laying across lot lines shown shall be removed or relocated to comply with City ordinances. · 15. Prior to issuing a grading or building permit, the development shall file a site development plan in accordance with Chapter 21.82 of the Carlsbad Municipal Code. 16. The applicant may request a review of the preliminary conditions within ten (10) days of the date of this approval. The request must be submitted in writing to the City Engineer in accordance with Section 20.24.120 through 140 of the Carlsbad Municipal Code.
