on April 3, 1991 the Carlsbad Planning WHEREAS,
Commission held a duly noticed public hearing to consider a
proposed Site Development Plan (SOP 90-5), conditional use Permit
(CUP 90-3), Hillside Development Permit (HOP 90-9) and Minor
Subdivision (MS 837) for a Price Club project on 62 acres of
property generally located south of Palomar Airport Road and east
of Paseo del Norte at the. At the conclusi·on of th h ' th e earing e
Commission adopted Resoluti· ons Nos 3209 . ' 3210, 3211 and 3212,
recommending to the City Council that the Site Development Plan
(SOP 90-5), Conditional Use Permit (CUP 90-3), Hillside Development
Permit (HOP 90-9) and Minor Subdivision (MS 837) respectively, be
approved; and
WHEREAS, the City Council of the City of Carlsbad, on May
7, 1991 held a duly noticed public hearing to consider the
Commission's reconunendatibns and heard all persons interested in
or opposed to SOP 90-5/CUP 90-3/HDP 90-9/MS 837; and
WHEREAS, the City Council on May 21, 1991 by adoption of
Resolution No. 91-152 approved a Conditional Negative Declaration
in compliance with the City of Carlsbad Environmental Protection
Ordinance and the California Environmental Quality Act,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the I
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct. I
2. That the Site Development Plan (SOP 90-5) on the
above referenced project is approved and that the findings and
conditions of the Planning Commission contained in Resolution No.
3209 marked Exhibit A attached hereto and made a part hereof are
the findings and conditions of the City Council except that
Conditions No. 57, 63, 64, 66 and 71 are revised and two new
conditions are added as contained in the Planning Director's
memorandum .of May 10, 1991 attached as Exhibit B hereto and made a
part hereof.
3. That the Conditional Use Permit (CUP 90-3) is
approved and that the findings and conditions of the Planning
Commission contained in Resolution No. 3210 marked Exhibit c
attached hereto and made a part hereof are the findings and
conditions of the City Council.
4. That the Hillside Development Permit (HOP 90-9) is
approved and that the findings and conditions of the Planning
Commission contained in Resolution No. 3211 marked Exhibi~ D and
attached hereto and made a part hereof are the findings and
conditions of the City Council.
5. That the Minor Subdivision (MS 837) is approved and
that the findings and condition of the Planning Commission
contained in Resolution No. 3212 marked Exhibit E and attached
hereto and made a part hereof are the findings and conditions of
the city council except as follows:
A. No vehicular access shall be permitted from
Parcel 1 to Paseo del Norte. The documents for MS 837 shall be
revised to comply with this condition to the satisfaction of the I

The developer shall provide the City with a reproducible 24" x 36", mylar copy of
the Tentative Map and Site Plan as approved by the Planning Commission. The
Tentative Map and Site Plan shall reflect the conditions of approval by the City.
The Map and Plan copy shall be submitted to the City Engineer prior to bui:ding, i
grading _or improvement plan submittal, whichever occurs first.
This project is approved upon the express condition that building permits will not
be issued for development of the subject property unless the City Engineer
determines that sewer facilities are available at the time of application for such
sewer permits and will continue to be available until time of occupancy.
This project is also approved under the express condition that the applicant pay the
public facilities fee adopted by the City Council on July 28, 1987 and as amended
from time to time, and any development fees established by the City Council
pursuant to Chapter 21. 90 of the Carlsbad Municipal Code or other ordinance 1
adopted to implement a growth management system or facilities and improvement
plan and to fulfill the subdivider's agreement to pay the public facilities fee dated
February 13, 1990, a copy of which is on file with the City Clerk and is
incorporated by this reference. If the fees are not paid this application will not be
consistent with the General Plan and approval for this project will be void.

No outdoor storage of material shall occur onsite unless required by the Fire Chief. i

The applicant shall prepare a detailed landscape and irrigation plan which shall be i
submitted to and approved by the Planning Director prior to the issuance of grading I
or building permits, whichever occurs first. i
All parking lot trees shall be a minimum of a 24 inch box in size.
All landscaped areas shall be maintained in a healthy and thriving condition, free
from weeds, trash, and debris.
The developer shall install street trees at the equivalent of 40-foot intervals along
all public street frontages in conformance with City of Carlsbad standards. The
trees shall be of a variety selected from the approved Street Tree List.
All landscape plans shall be prepared to conform with the Landscape Manual and
submitted per the landscape plan check procedures on file in the Planning
Department.
Landscape plans shall be designed to minimize water use. Lawn and other zone 1
plants (see Landscape Manual) shall be limited to areas of special visual importance
or high use. Mulches shall be used and irrigation equipment and design shall
promote water conservation.
The developer shall avoid trees that have invasive root systems, produce excessive 1
litter and/or are too large relative to the lot size.
Planter width shall be a minimum of four (4) feet, not including curb, footings
and/ or other paving, and parking overhang.
Prior to final occupancy, a letter from a California licensed landscape architect shall
be submitted to the Planning Director certifying that all landscaping has been
installed as shown on the approved landscape plans.
The applicant shall pay a landscape plan check and inspection fee as required by
Section 20.08.050 of the Carlsbad Municipal Code.
The first set of landscape and irrigation plans submitted shall include building plans,
improvement plans and grading plans.
All landscape and irrigation plans shall show existing and proposed contours and
shall match the grading plans in tertllS of scale and location of improvements.

Close the access to Paseo Del Norte to automobiles until the

Construct full signalized ;ntersection on Palomar Airport Road at the
east entrance of the Price Oub site including the addition of an added
eastbound right tum lane on Palomar Airport Road into the project.
To mitigate any aesthetic impacts that development on this site could create,
the following measures are required as pan of this project:

The applicant shall pay park-in-lieu fees to the City, prior to the approval of the I
final map as required by Chapter 20.44 of the Carlsbad Municipal Code. :

This approval shall become null and void if building permits are not issued for this
project within rwo years from the date of project approval.
Approval of SDP 90-5 is granted subject to the approval of GPA 90-1, LCPA 90-2,
ZC 90-.1, CUP 90-3, HDP 90-9 and MS 837.
Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates
pursuant to City standards. Location of said receptacles shall be approved by the
Planning Director. Enclosure shall be of similar colors and/or materials to the
project to the satisfaction of the Planning Director.

Prior to the issuance of grading permits, the project applicant shall receive a Coastal
Development Permit from the California Coastal Commission that approves
development that is in substantial conformance with the City approval. Evidence
that the permit has been received shall be submitted to both the Planning and
Engineering Departments.
The applicant shall be responsible for implementing the required mitigation
measures. All suhmittals to the City of Carlsbad to fulfill the conditions of the
Conditional Negative Declaration shall reference: 1) the project file No. GPA 90-
1/LCPA 90-2/ZC 90-1/SDP 90-5/CUP 90-3/HDP 90-9/MS 837; 2) the Conditional

weekly schedule to prevent the accumulation of dirt/ oil/ grease which could
be washed into the storm drain system. Sweeping of areas south of the

automobiles shall be removed from waters leaving the site by directing
drainage through an oil trap subject to the approval of the City Engineer.

Exhibit "B" dated April 3, 1991 from the Seagate Condominium Project to the south
if and when it is determined to be necessary by the Planning Director.
The project shall provide bus stop facilities at locations subject to the satisfaction

This project is located in Zone 5 Local Facilities Management Plan. Recent traffic
monitoring has revealed that Palomar Airport Road from El Camino Real to the
eastern City limit falls below the adopted performance standard. Therefore, prior ' i to the issuance of a building permit, the owner shall participate in the guarill1tee of

conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The
developer shall apply for an industrial waste water discharge permit concurrently
with the building permit for this project. No Certificates of Occupancy for the
project will be issued before the industrial waste discharge permit application
requirements have been met, all applicable fees paid and permit issued.
Based upon a review of the proposed grading and the grading quantities shown on
the site plan, a grading permit for this project is required. Prior to issuance of a i
building permit for the project, the applicant must submit and receive approval for I
grading plans in accordance with City codes and standards, be issued a grading
permit and complete the grading work in substantial conformance with the ap-
proved grading plans.
The developer shall obtain a grading permit prior to the commencement of any
clearing or grading of the site.
A separate grading plan shall be submitted and approved and a separate grading
permit issued for the borrow or disposal site if located within the city limits.
Prior to hauling dirt or construction materials to any proposed construction site
within this project the developer shall submit to and receive approval from the City
Engineer for the proposed haul route. The developer shall comply with all
conditions and requirements the City Engineer may impose with regards to the
hauling operation.
The developer shall exercise special care during the construction phase of this
project to prevent offsite siltation. Planting and erosion control shall be provided

Additional drainage easements and drainage structures shall be provided or installed
prior to the issuance of grading or building permit as may be required by the City ,I

The developer shall make an offer of dedication to the City for all public streets and i
easements required by these conditions or shown on the site plan. The offer shall
be made by a certificate on the final map for this project. All land so offered shall
be granted to the City free and clear of all liens and encumbrances and without cost
to the City. Streets that are already public are not required to be rededicated.
Some improvements shown the site plan and/or required by these conditions are
located offsite on property which neither the City nor the subdivider has sufficient
title or interest to permit the improvements to be made without acquisition of title
or interest. The Developer shall conform to Section 20.16.095 of the Carlsbad
Municipal Code.
Prior to approval of any grading or building permits for this project, the owner shall
give written consent to the annexation of the area shown within the boundaries of
the site plan into the existing City of Carlsbad Street Lighting and Landscaping
District No. 1. The form shall be provided by the City during the improvement
plancheck process.
The drainage system shall be designed to ensure that runoff resulting from a l 0-year
frequency storm of a 6 hours or 24 hours duration under developed conditions, is
equal to or less than the runoff from a storm of the same frequency and duration
under existing developed conditions. Both 6 hour and 24 hour storm durations shall
be analyzed to determine the detention basin capacities necessary to accomplish the
desired results.
Runoff from this project is conveyed to environmentally sensitive areas. The
developer shall provide adequate means of eliminating grease and oils from draina_ge
prior to discharge. Plans for such improvements shall be approved by the Ctty
Engineer prior to issuance of grading or building permit.
Plans, specifications, and supporting documents for all improvements shall be ,
prepared to the satisfaction of the City Engineer. Prior to_ approval of the fin~! map '
in accordance, with City Standards the Developer shall mstall, or agree to mstall

north, south and east legs of the intersection including appropriate transi-
tions to the satisfaction of the City Engineer. Include modification to the
traffic signal at the intersection of Palomar Airport Road and Paseo Del Norte
including appropriate traffic signing and striping. All of these improvements
and work shall be coordinated with the improvements to the interchange at
1-5.
Improvements listed above shall be constructed within 18 months of parcel map
approval and/or improvement plan approval, whichever occurs first.
The Fire Marshal has determined that onsite fire hydrants are required to serve this
project. Prior to issuance of a building permit for the site, the applicant must
submit and receive City and water district approval for appropriate waterline
improvement plans and easements. All improvements shall be designed in
conformance with City and Water District Standards, plancheck and inspection fees
paid and improvement security shall be posted with the Water District.

Price Club -Proposal to amend Condition No. 66
Staff is recommending that Condition No. 66 for Price Club be amended to add the
following:
The easement documents shall be worded such that the grant is not e!Tective
until the following conditions are met:
A. The use of the casement l,y either property is compatible with the
commercial use of the Price Club property with regard tu vehicle types,
traffic generation rates and adherence to traffic rules as determined
by the City.
B. The owner of the adjacent property agrees to share in the cost of
maintenance and insurance based upon a pro-rata share of traffic
using the easements.
C. The owner of the adjacent property agrees to hold the Price Club
harmless from any liability associated with the adjacent pruperty
owners use of the easement, and maintain independent liability
insurance coverage.
D. For the Nurseryland property only, one or uuth of the existing
driveways on the Nurseryland property are closed to the satisfaction
of the City.
Staffs primary motivation in amending the existing condition is to clarify that utilization of

The food concessions permitted on the site by CUP 90-3 as shown on exhibits "A" -
"N", dated April 3, 1991 shall have their hours of operations limited to the same
hours which the Price Oub Store is open.
Thf' maximum number of tables permitted outside the Price Oub Store is 6 tables
to be used by customers for sit down outdoor eating. Additional tables for food
preparation such as condiments may be permitted and will not be included as part
of the maximum of 6 tables allowed.
A total of 9 parking spaces are required for the food concessions use.

restriction on real property placed on the deed to property subject to the
satisfaction of the Planning Director notifying all interested parties and successors

Approval is granted for MS 837, as shown on Exhibit(s) "A" . "N", dated April 3,
1991, incorporated by reference and on file m the Planning Department.
Development shall occur substantially as shown unless otherwise noted. in these
conditions.
The developer shall provide the City with a reproducible 24" x 36", mylar copy of
the Tentative Map as approved by the Planning Commission. The Tentative Map
shall reflect the conditions of approval by the City. The Map copy shall be
submitted to the City Engineer prior to building, grading or improvement plan
submittal, whichever occurs first.
This project is approved upon the express condition that building permits will not
be issued for development of the subject property unless the City Engineer
detennines that sewer facilities are available at the time of application for such
sewer permits and will continue to be available until time of occupancy. This note
shall be placed on the final map.
This project is also approved under the express condition that the applicant pay the
public facilities fee adopted by the City Council on July 28, 1987 and as amended
from time to time, and any development fees established by the City Council
pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance
adopted to implement a growth management system or facilities and improvement
plan and to fulfill the subdivider's agreement to pay the public facilities fee dated
February 13, 1990, a copy of which is on file with the· City Clerk and is
incorporated by this reference. If the fees are not paid this application will not be
consistent with the General Plan and approval for this project will be void.
The applicant shall pay park-in-lieu fees to the City, prior to the approval of the
final map as required by Chapter 20.44 of the Carlsbad Municipal Code.
Water shall be provided to this project pursuant to the Water Service agreement
between the City of Carlsbad and the Carlsbad Municipal Water District, dated May
25, 1983 subject to availabil,ity.

This project shall comply with all conditions and mitigation measures which may
be required as part of the Zone 5 Local Facilities Management Plan and any
amendments made to that Plan prior to the issuance of building permits.
If any condition for construction of any public improvements or facilities, or the
payment of any fees in lieu thereof, imposed by this approval or imposed by law on
this project are challenged this approval shall be suspended as prmided in
Government Code Section 65913.5. If any such condition is determined to be
invalid this approval shall be invalid unless the City Council determines that the
project without the condition complies with all requirements of law.
Approval of this request shall not excuse compliance with all sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of final map
approval.

The applicant may request a review of the preliminary conditions within (I 0) days
of the date of this approval. The request must be submitted in writing to the City
Engineer in accordance with Section 20.24.120 through 140 of the Carlsbad Munici-

The tentative parcel map approval shall expire two (2) years from the date of the
letter containing the final decision for tentative parcel map approval.

25. This subdivision contains a remainder parcel. No building permit shall be issued for

26. Per State laws governing the associated Palomar Airport Road Assessment District,
AD 86-1, a segzegation of the assessments to the subject property must be applied
for or the assessment must be paid off in full prior to the approval of the Parcel
