A preliminary decisioh has been made, pursuant to Section 20.24.120 of the City of

The developer shall provide the City 1,vith the reproducible 24" x 36" mylar
copy of the tentative parcel map as approved by the City Engineer. The
· tentative parcel map shall reflect the conditions of approval by the City. The
map copy shall be submitted to the City Engineer prior to issuance of
building permits, or submittal of final map, improvement plans, or grading
permits submittal, whichever occ~1rs first.
The parcel map shall comply with the Land Use Planning Office
memorandum for Minor Subdivision No. 841, dated January 31, 1991
(attached hereto).
The tentative parcel map approvz.l shall expire two (2) years from the date
of the letter containing the final decision for tentative parcel map approval.
Unless a ·standard variance has been issued, no variance from City Standards
is authorized by virtue of approval of this tentative parcel map.
Prior to approval of the parcel map the developer shall pay and/or enter into
a::--, ugrcement ·.-,:ith the c-:.::y tc JJ::ry any dr~.inage area fees established as a
result of the forthcoming Master Drainage Plan Update·.
The applicant shall pay park-in-lieu fees to the City prior to the approval of
the parcel map as required by Chapter 20.44 of the Carlsbad Municipal
Code.
The subdivider shall be responsible to pay the recording fees for all
agreements, easements and documents required for this project.
The owner shall enter into lien contract for the future improvement of
Adams Street along the subdivision frontage for a half street width of 30 feet
prior to approval of the parcel map. Improvements shall include but not be
limited to paving, base, sidewalks, curbs and gutters, grading, clearing and
grubbing, undergrounding or relocation of utilities, sewer, water, fue
hydrants or retaining walls.

All required fees and deposits shall be paid prior to parcel map approval.
This project is approved under the eA'J)ress condition that the applicant pay
the additional public facilities fee adopted by the City Council on July 28,
1987, and any development fees established by the City CoJncil pursuant to
Ordinance No. 9791 or subsequent ordinance adopted to implement a
growth or development management system or public facilities phasing plan
to fulfill the subdivider's agreement to pay the public facilities fee, a copy of
which is on file with the City Clerk and is incorporated by this reference.
If the fees are not paid, this applicadon will nor be consistent with the
General Plan and approval for this project shall be void.
Based upon a review of the proposed grading and the grading quantities
shown on the tenative map, a grading permit for this project is required.
Prior to issuance of a building permit for the project, the applicant must
submit and receive approval for grading plans in accordance with City codes
and standards1 be issued a grading permit and complete t.i.e grading work
in substantial conformance with the approved grading plans.
The owner of the subject property shall execute a hold hannless agreement
regarding drainage across the adjacent property prior to approval of the final
map for this project.
The drainage system shall be designed to ensure that runoff resulting from
a 10-year frequency storm of a 6 hours or 24 hours duration under
developed conditions, is equal to or less than the runoff from a storm of the
same frequency and duration under existing developed conditions. Both 6
hour and 24 hour storm durations shall be analyzed to determine the
detention basin capacities necessary to accomplish the desired results.
Prior to prrrcel map approval tlie developer shall grant a reciprocal access
easement sho\lm as a common use driveway on the tentative map. The
easement shall be shown and recording information called out on the parcel
map.
Prior to final map, the owner shall make an irrevocable offer to dedicate a
15 wide public sewer easement along the westerly line of Parcel No. 2 as
sho\lm on the tentative map.
The applicant may request a review of the preliminary conditions within
(10) days of the date of this approval. The request must be submitted in
writing to the City Engineer in accordance -with Section 20.24.120 through
140 of the Carlsbad Municipal Code.
The owner of the subject property shall execute a Hold Hamless Agreement
regarding the panhandle lot prior to approval of the parcel map.

18. This project is approved upon the express condition that building pennits
will not be issued for development of the subject property unless the City
Engineer detennines that sewer facilities are available at the time of
application for such sewer pennits and will continue to be available until
time of occupancy. This note shall be placed on the parcel map.
19. Prior to final map approval grading on Adams Street shall be completed in
substantial conformance with grading permit PE 2.90.24 anc: drawing 314-1
and to the satisfaction of the City Engineer.

Whereas no review of the conditions of the letter of preliminary approval
was requested by the appropriate date; and whereas the requiremems of the
California Environmental Quality Act and the City of Carlsbad Environmental
Protection Ordinance of 1973 relating to the subject proposed parcel map
have been examined by the Planning Director and declared to have a non-
significant impact upon the environment; and whereas negative findings
delineated by Section 20.24.130 of the Carlsbad Municipal Code have not
been made; and whereas this minor subdivision is found to be in conformity
with the General Plan of the City of Carlsbad; therefore, a final decision has
been made to approve the subject tentative parcel map subject to the
conditions set forth in the preliminary approval letter.

Condition No. 19 is changed to read:
"Prior to issuance of a building permit for either Parcel 1 or Parcel 2 grading
and improvements on Adams Street shall be completed in substantial confor-
mance with grading permit PE 2.90.24 and Drawing 314-1 and to the satis-
faction of the City Engineer.
A note to this effect shall be placed on a non-mapping sheet of the final
parcel map.11
This letter also corrects an understanding reached at a meeting on March 29, 1991 be-
tween Mr. Benson, Mr. Donaldson and Jim Davis.
Condition No. 6 will have to remain in force as required by Section 20.44.050 of the
Carlsbad Municipal Code. Under this section of Code, park-in-lieu fees may be paid prior
to issuing a building permit provided the subdivider concludes a secured agreement to pay
such fees and a note of obligation to pay such fees is placed on a non-mapping sheet of the
final parcel map. The fee for this project is $786.00 (one additional dwelling unit).
