SOP B9-10 FOR A JEEP/EAGLE AUTO DEALERSHIP ON PROPERTY GEtlERALLY LOCATED WEST OF CAR COUNTRY DRIVE ANO SOUTH OF CAtltlON ROAD. APPLICANT: PACIFIC JEEP/EAGLE CASE NO: SOP 89-lO WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did, on the 2nd day of August, consider said request on property described as: Lot 7 of Carlsbad Tract 87-03 being a subdivision of a portion of Lot Hof Rancho Agua Hedionda in the City of Carlsbad, County of San Diego, State of California, according to Map No. 82-3 filed in the office of the County· Recorder of said County November 16, 1896, APN 211-080-07. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of an persons desiring to be heard, said Commission considered all factors relating to SOP 89-10. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. 8) That based on.the evidence presented at the public hearing, the Commission APPROVES SOP 89-10, based on the following findings and subject to the following conditions: Findings: I. The project is consistent with CT 87-3 and meets all the requirements of the General Plan, Zone, Specific Plan, Local Facilities Management Plan for Zone 3, and Local Coastal Plan Mello II. 2. The project is architecturall_y compaUble with the surrounding Car Country dealerships, and uses a Span1sh arch1tectural theme with slumpstone wa11s and Mission Tile roofing. 3. The Planning Commission has, by inclusion of an appropriate condition to this proJect'. ensured building permits will not be issued for the project un~es~ the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and the Planning Commission is satisfied that the requirements of the Pub I ic Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project. 4. The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that pub! ic facilities will be available concurrent with need as required by the General Plan. 5. Assurances have been given that aciequate sewer for the project will be provided by the City of Carlsbad. 6. The proposed project is compatiblr with the surrounding future land uses since surrounding properties are designated for residential development on the Extensive Regional Retail (RRE) General Plan. 7. This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Planning Director on May 31, 1989 and approved by the Planning Commission on August 2, 1989. In approving this Negative Declaration the Planning Commission has considerrc the initial study, the staff analysis, all requir,d mitigation measu·,es and any written comments received regarding the significant effects this project could have on the environment" 8. The applicant is by condition, required to pay any increase in public facility fee, or new construction tax, or development fees, and nas agreed to abide by any additional requlrei.,cnts established by a Local Facilities Management Plan prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensure continued availability of public facilities and will mitio"tc ·.oy cumulative impacts created by the project. g_ This prqject is consistent with the City1 s Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facll ities Management Plan for Zone 3. Conditions: 1. Approval is granted for SOP 89-10, as shown on Exhibits 'A" -"H", dated July II, 1989, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. The developer shall provide the City with a reproducible 24" x 36", 100 scale_mylar copy of the site plan as approved by the Planning Commission. The site plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the City Engineer prior to Issuance of building permits or improvement plan submittal 1 whichever occurs first, 3. This project Is approved upon the express condition that building permits wil 1 not be issued for development of the subject property unless the City Enginee~ determines that sewer facllities are available at the time of application for such sewer permits and will continue to be avai1able untll time of occupancy. 4. This project _is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Counci"I on July 28, 1987 and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfill the subdivider's agreement to pay the_ public facilities fee dated September 28, 1988, a copy of which are on file with the City Clerk and are incorporated by this reference. If the fees are not paid this application wi'1 not be consistent with the Gen°ral Plan and approval for this project ,-,.,11 be void. 5. Water shall be provided to this project pursuant to _the Water Service agreement between the City of Carlsbad and the Carlsbad Municipal Water District, dated May 25, 1983. 6. This project shall comply with all conditions and mitigation required by the Zone 3 Local Facilities Management Plan approved by the City Council, incorporated herein and on file in the Planning Department and any future amendments to the Plan made prior to the issuance of building permits. 7. If any condition for constri1ct.ion of any public improvements or +acilities, or tl1e payment 1.J'i any fees in ·1 ·:eu th·~reof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. 8. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuan~e. 9. Trash receptacle areas shall be enclosed by a six-foot high masorry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Planning Director. 10. All roof appurtenances, including air conditioners, sha11 be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Pol icy No. 80-6, to the satisfaction of the Directors of Planning and Building. 11. Compact parking spaces shall be located in large groups in locations to the satisfaction of the Planning Director. 12. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. 13. Due to the intense use of the subject site, no other dealership shall be permitted without approval by the Planning Cormiission. 14. An exterior lighting plan showing architectural style and lumens shall be submitted for Planning Director approval prior to-building permit issuance. All lighting shall be in conformance with SP !9(C) Kand shall be designed to reflect downward and avoid impacts on adjacent property, 15. A test driving map shall be submitted for Planning Director approval prior to issuance of building permits. This map shall be available to all sales and service employees in order to designate areas for test driving. This map shall note that test driving in residential areas is prohibited. 16. Prior to the issuance of any City Permits, the applicant shall submit a copy of a valid Coastal Development Permit allowing construction of this project which is in substantial conformance with this approval. 17. All employee,-customer, and service parking as shown an the site plan shall be clearly demarcated by signs and shall be kept free of display or inventory parking. 18. The applicant shall provide tables and benches within the outdoor lunch areas. The lunch area shall be constructed concurrently with the proposed buildings and completed prior to occupancy. A slumpstone block wall shall be constructed between the transformer and_ the eating area. 19. All signs proposed sha 11 be in accordance with the sign criteria sho"'n on Exhibit "B" .. In accordance with the Mello II LCP segment, a pole sign is not approved for this project. 20. This Site Development Plan shall become null and void if h.ililding permits have not been issued within one year of the date of approval. Any extension to this provision must be approved by the Planning Commission 21. This project is approved subject to the condition that no paper signs, banners or flags in any windows or within 24 inches of any window on this pre;nises be allowed. Also·excluded are the use of balloons, and the outdoor display of merchandise (other than autos). The applicant shall include these restriction in the lease agreement with lessees. 22. The 6' high slumpstone wall proposed along the western property line shall be required to be covered with a slurry coat. The slurry coat shall be required to be colored one of the three approved beige colors on file in the Planning Department. Engineering: 23. The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. 24. The grading for this project is defined as "regular grading" by Section ll.06.170(a) of the Carlsbad Municipal Code. The developer shall submit a grading plan for approval which shall include all required drainage structures and any required erosion control measures. The developer shall also submit soils, geologic or compaction reports if required and shall comply with all provisions of Chapter 11.06 of the Carlsbad Municipal Code. 25. No grading shall occur outside the 1 lmits of the rroject unless a letter of permission is obtained from the owners of the affected properties. 26. A separate grading plan shall be submitted and approved and a separate grading permit issued for the borrow or disposal site if located within the city limits. 27. All slopes within this project shall be no steeper than 2: I. 28. Prior to hauling dirt or construction materials to any proposed ronstruction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. 29. Additional drainage easements and drain.ye structures shall be provided or installed as may be required by the ( ·ny Engineer. 30. The deve1cper shall be responsible for coordination with S.D.G.&E .. Pacific Telephone, and Cable TV authorities. 33. The applicant shall agree to utilize reclaimed water, In Type I form, on the subject property in all common areas as approved by the City Engineer 34. Irrigation systems to accommodate future reclaimed water shall be designed consistent with Title 17 of the California Administrative Code. Offsite future reclaimed water distribution systems should be anticipated by the installation of adequately sized sleeves at crossing points to minimize street excavation. t ' , ire Londitions: 35. Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department. 36. Additional public and/or oitsite fire hydrants shall be provided if deemed necessary by the Fire Marshal. 37. The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Mar.',al for approval. 38. An all-weather access road shall be maintained throughout construction. 39. All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. 40. Proposed security gate systems shall be provided with "Knox" key operated override switch, as specified by the Fire Department. 41. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction. 42. All roof-top appurtenances shall be architecturally integrated into the design of the building and shielding to prevent noise and visual impacts, subject to approval before issuance of permit. 43. Building exceeding 10,000 sq. ft. aggregate floor area shall be sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000 sq. ft. (or less) areas, PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 2nd day of August, 1989, by the following vote, to wit: AYES: Chairma,, Hall, Commissioners: Schlehuber, Erwin, McFadden, Holmes, Schramm & Marcus.
