To whom it may concern,
Please note the following justification for the Consistency Determination application for 2465
Jefferson Street -CDP 2019-0015/NCP 2020-0002.
Description of Proposal:
Increase the area of the exterior terrace patio cover from 320 SF to 520 SF. Increase the area of the
second-floor terrace from 75 SF to 177 SF. Increase roof pitch on existing 1-story section (south
wing); increase from 2:12 to 3.5:12. Roof height increase of 12'-3" to 13'-3".

1. No project condition, feature, facility or amenity is changed or deleted that had been
considered essential to the project's design, quality, safety or function.
Response: The expansion of the exterior terraces and roof pitch increase will not delete any
essential design features. The proposed changes to the project are located in the rear of the
house and not visible from the front or public street. The roof pitch will now match the other
new roof areas to provide better drainage and consistency in appearance.
2. The request represents an upgrade in overall design features and or materials and improves
upon the project's compatibility with the surrounding neighborhood.
Response: The proposed expansion of the exterior terraces and roof pitch increase will
maintain the project's design, quality and/or improve the project's design, quality. For example;
the columns of the proposed expanded terrace patio cover will be stone-clad, where the
previous design utilized wood posts. The roof pitch will now match the other new roof areas to
provide better drainage and consistency in appearance.
3. The proposed revision does not change the density (i.e. the addition of units) or boundary of
the subject property.
4. Response: The proposed expansion of the exterior terraces and roof pitch increase will not add
any interior area. The area subject to proposed expansion are exterior spaces and do not
increase any density.
5. The proposed revision does not involve the addition of a new land use not shown on the
original permit.
Response: The proposed expansion of the exterior terraces and roof pitch increase will not
involve any new land use. It is merely an expansion of an approved ground level terrace patio
cover and an existing second floor terrace.
6. The proposed revision does not rearrange the major land uses within the development.
7. Response: The proposed expansion of the exterior terraces and roof pitch increase will not
involve any re-arrangement of land use. It is merely an expansion of an approved ground level
terrace patio cover and an existing second floor terrace.
8. The proposed revision does not create changes of greater than ten percent (10%), provided
that compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code as follows:
a. Per individual lot or structure -yards, setbacks, coverage or height.
Response: The proposed expansion of the exterior terraces will not create change greater than
10%. The rear yard setback to the terrace structure will decrease from 145 LF to 138 LF (8. 7%
reduction).
The approved lot coverage of 17.5% (4,675/26,603) will be increased by 302 SF which equals a
6.45% increase in lot coverage area. The proposed lot coverage will increase to 18.7% -a 7%
increase in percentage.

The revision in the roof pitch will increase the overall height of the affected roof area by 12"
making the overall height of the one-story section 13'-3". The approved roof height of 12'-3"
will be increased by 8%. This increase is less than 10% and well below the maximum roof height
of 35'.
9. The proposed change will not result in any significant environmental impact, and/or require
additional mitigation.
Response: The proposed expansion of the exterior terraces and roof pitch increase will not
involve any environmental impact in any way. It is merely an expansion of an approved ground
level terrace patio cover and an existing second floor terrace and increase of the roof pitch on
the existing south wing of the house.
10. The proposed change would not result in any health, safety or welfare impacts
Response: The proposed expansion of the exterior terraces and roof pitch increase will not
involve any result in any health, safety or welfare impact in any way. It is merely an expansion
of an approved ground level terrace patio cover and an existing second floor terrace and
increase of the roof pitch on the existing south wing of the house. The health, safety and
welfare of the residents will improve by increasing the roof pitch for better drainage.
11. There were not any major issues or controversies associate with the original project which
would be exacerbated with the proposed change; and
Response: The proposed expansion of the exterior terraces and roof pitch increase will not
result in any major issues or controversies associated with the original project in any way. There
were no major issues or controversies associated with this project during the original coastal
development permit application.
12. The proposed change would not be readily discernable to the decision makers as being
substantially different from the projects originally approved.
Response: The proposed expansion of the exterior terraces and roof pitch increase will not be
readily discernable since the proposed changes are located in the rear of the property and not
visible from the front or public street.
