NOTICE OF RESTRICTION ON REAL PROPERTY
ACCESSORY DWELLING UNIT
The real property located in the City of Carlsbad, County of San Diego, State of California
described as follows:
LOT 5 OF SCHELL AND SITES ADDITION TO CARLSBAD, IN THE CITY
OF CARLSBAD, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA,
ACCORDING TO MAP THEREOF NO. 2145, FILED IN THE OFFICE OF
THE COUNTY RECORDER OF SAN DIEGO COUNTY, FEBRUARY 20,
1929.
has been approved for an ACCESSORY DWELLING UNIT by the City of Carlsbad on AUGUST
7, 2023. Said approval restricts the property as follows:
1. The obligations and restrictions imposed on the ACCESSORY DWELLING UNIT
per California Government Code Section 65852.22 are binding on all present and future
property owners.
2. Pursuant to Section 21 .10.030 of the City of Carlsbad Municipal Code, the property
owner(s) shall reside in either the primary residence or the ACCESSORY DWELLING
UNIT.
3. Pursuant to Section 21.10.030 of the City of Carlsbad Municipal Code, sale of the
ACCESSORY DWELLING UNIT separate from the single-family dwelling is prohibited.
Said prohibition is binding on all present owners and future purchasers.

4. Pursuant to Section 21.10.030 of the City of Carlsbad Municipal Code, if the
ACCESSORY DWELLING UNIT is rented, a rental period of less than 30 days is
prohibited. This requirement does not apply to any unit that was issued a building permit
prior to January 1, 2020.
