I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3559, recommending APPROVAL of the amendment to the Zone 11 and 12 Local Facilities Management Plans based on the findings contained therein. II. PROJECT DESCRIPTION AND BACKGROUND The Zones 11 and 12 Local Facilities Management Plans (LFMP) were originally adopted on February 23, 1988, and August 21, 1990, respectively. On May 19, 1992, the City Council approved the Financing Plans for Zones 11 and 12 which called for the formation of an Assessment District to finance the construction of Rancho Santa Fe Road, Olivenhain Road, and other related minor infrastructure improvements. Changing economic conditions have made the option of Assessment District formation infeasible. As such, the City in cooperation with the property owners in Zones 11 and 12 have now determined that a Community Facilities District (CFO) may be the preferred financing mechanism in place of an Assessment District for the required facilities. The proposed amendment would simply allow for this alternate financing option. No other changes to the Local Facilities Management Plan are proposed at this time. The following is a summary of the updated status of each of the facilities for Local Facilities Management Plan Zones 11 and 12. City Administrative Facilities, Library, and Parks. Community Facilities District (CFO) No. 1 was formed in 1991 to finance a number of facilities of Citywide benefit. All properties in Zones 11 and 12 are already participating in CFO No.1. A combination of CFO No. 1 and payment of Public Facilities Fee (PFF) constitutes the required financial guarantee for City Administrative Facilities and Library. Park facilities are guaranteed by a combination of park-in-lieu Fees, PPP, and compliance with special conditions of the LFMP. LFMP 87-ll(A)/LFMP 87-.L.c.(A) ZONE 11 and 12 LOCAL FACILITIES MANAGEMENT PLANS OCTOBER 20, 1993 PAGE 2 Wastewater Treatment Capacity. The Phase N expansion of the Encina Water Pollution Control Facility has been completed. Therefore, the special conditions stated in the approved LFMP's are now satisfied. Drainage. All development within Zones 11 and 12 will be required to construct drainage facilities or pay any drainage area fee established by the Revised Drainage Master Plan. Circulation. With the required mitigation, Zones 11 and 12 will meet the standards of the Growth Management Ordinance. Open Space. Open space within Zones 11 and 12 will be in compliance with the latest adopted standards. Schools. Pursuant to state law, Zones 11 and 12 will pay required school fees in effect at the time of development. Fire. With the establishment of temporary fire station #6, Zones 11 and 12 meet established standard. Water and Sewer. All facilities will be provided pursuant to the 1990 Water Master Plan. All potable water and reclaimed water facilities required to serve Zones 11 and 12 will be constructed or appropriate fees paid at the time of development. Sewer facilities will be provided to meet established standards. m. ANALYSIS Planning Issues 1. Does the proposed amendment to the Zones 11 and 12 Local Facilities Management Plans satisfy all requirements of the Growth Management Ordinance (Chapter 21.90 of the Carlsbad Municipal Code)? DISCUSSION The proposed amendments to the Zone 11 and 12 Local Facilities Management Plans have been prepared in accordance with Chapter 21.90 of the Carlsbad Municipal Code. The present financing plans for Zones 11 and 12 specifically call for the formation of an "Assessment District" to fund facilities. The proposed amendment would perm.it the use of a Community Facilities District or other financing program acceptable to the City Council to fund facilities. This change is consistent with the City's Growth Management Ordinance (Chapter 21.90 of the Carlsbad Municipal Code). -LFMP 87-ll(A)/LFMP 87-.L-4(A) ZONE 11 and 12 LOCAL FACILITIES MANAGEMENT PLANS OCTOBER 20, 1993 PAGE 3 IV. ENVIRONMENf AL REVIEW - The proposed LFMP amendment is covered by a previously approved Negative Declaration issued by the Planning Director on December 11, 1987 for Zone 11 and EIR 86-02 for Zone 12. Project Title: Zones 11 and 12 Local Facilities Management Plan Amendments Project Location: Generally located east of El Camino Real and south of Alga Road in the southeast quadrant of the City of Carlsbad. Project Description: Request for an amendment to Zones 11 and 12 LFMP's to include revisions to the financing plan. Justification for this determination is on file in the Planning Department, Community Development, 2075 Las Palmas Drive, Carlsbad, California 92009. Comments from the public are invited.
