HomeMy WebLinkAbout2023-10-10; City Council; Resolution 2023-257RESOLUTION NO. 2023-257 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE PLANS, SPECIFICATIONS AND CONTRACT DOCUMENTS AND AUTHORIZING THE CITY CLERK TO ADVERTISE FOR BIDS FOR THE EMERGENCY OPERATIONS CENTER RECONFIGURATION PROJECT, AUTHORIZING AND DIRECTING THE DEPUTY CITY MANAGER, ADMINISTRATIVE SERVICES, TO TRANSFER FUNDS FROM CAPITAL IMPROVEMENT PROGRAM PROJECT NO. 4719 TO PROJECT NO. 4715, APPROVING AN INCREASE TO THE CONSTRUCTION CONTINGENCY FOR CONTRACT NO. PWS22-1552FAC TO $1,910,219, AND APPROVING AN INCREASE TO THE CITY MANAGER'S CHANGE ORDER AUTHORITY WHEREAS, the City Council has determined it necessary, desirable and in the public interest to construct the project as designed; and WHEREAS, the City Council of the City of Carlsbad, California has determined that the plans, specifications and contract documents for the Emergency Operations Center Reconfiguration, Capital Improvement Program, or CIP, Project No. 4715 have been completed to the satisfaction of staff; and WHEREAS, the plans, specifications and contract documents for the project are on file at the City Clerk's office and are incorporated by reference; and WHEREAS, City Council approval of the plans and specifications is required under Carlsbad Municipal Code Section 3.28.080(E) because the expected value to construct the project exceeds the $200,000 limit established by the Public Contract Code, including the alternative provisions of the Uniform Public Construction Cost Accounting Act; and WHEREAS, the City Council authorizes the City Clerk to advertise for bids for the Emergency Operations Center Reconfiguration Project; and WHEREAS, the City Council approve increasing the contingency and the City Manager's change order approval authority from $1,310,219 to $1,910,219, as may be needed for authorization of future project change orders for the Police and Fire Headquarters Renovation Project, CIP Project No. 4715, including contract no. PWS22-1552FAC; and WHEREAS, the City Council has determined it necessary to combine the remaining funding appropriated to CIP Project No. 4719 to the funding appropriat~q to CIP Project No. 4715 due to a facility name change and alignment of projects; and WHEREAS, the City Planner has determined that the project belongs to a class of projects that the State Secretary for Natural Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301 (d) Class 1 of the California Environmental Quality Act, or CEQA, Guidelines. Further, that in making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project, and that the project is consistent with 15301 (d) Class 1 because it consists of maintenance of public facilities, such as restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the plans, specifications and contract documents for the Emergency Operations Center Reconfiguration, CIP Project No. 4715, are approved and on file at the City Clerk's Office. 3. That the City Clerk is hereby authorized and directed to publish, in accordance with state law and Carlsbad Municipal Code Section 3.28.080(C), a notice to contractors inviting bids for construction of the project in accordance with plans, specifications and contract documents referred to herein. 4. That the Deputy City Manager, Administrative Services, is hereby authorized and directed to combine the remaining funding appropriated to CIP Project No. 4719 to the funding appropriated to CIP Project No. 4715. 5. That the project's contingency amount and City Manager's change order approval authority are increased to $1,910,219, as may be needed for authorization of future project change orders for the Police and Fire Headquarters Renovation, CIP Project No. 4715, including contract no. PWS22-1552FAC. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 10th day of Oct., 2023, by the following vote, to wit: AYES: NAYS: ABSTAIN : ABSENT: Blackburn, Bhat-Patel, Acosta, Burkholder.
