Attached for review by the Housing Commission, prior to the noted meeting, is a copy of Ordinance No. NS-235 which amended Title 2 of the Carlsbad Municipal Code by repealing Chapter 2.40 and adding a new chapter 2.40 to establish a Housing Commission. Ordinance NS-235 was approved on April 6, 1993. Also attached is a copy of Ordinance No. NS-242 which amended Sections 2.40.020, 2.40.030 and 2.40.050 of Chapter 2.40 to reflect a nine member commission (rather than the original 7 member commission) and revise qualifications for the members to be appointed to the Commission. All members of the Housing Commission are required to be residents of the City of Carlsbad and registered voters. 1 2 3 4 5 ORDINANCE NO. NS-235 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2 OF THE CARLSBAD MUNICIPAL CODE BY REPEALING CHAPTER 2.40 AND ADDING A NEW CHAPTER 2.40 TO ESTABLISH A HOUSING COMMISSION 6 DBRBAS the City declared on November 6, 1979 in 7 Ordinance No. 1223 a need for both a Housing Authority and 8 Redevelopment Agency pursuant to Health and Safety Code 9. Section 34110; and 10 DBRDS the city declared the need for the joint 11 operation of the Housing Authority and Redevel.opment Agency 12 as a community Development commission; and 13 WBBRBAS at that time the City Council declared itself 14 to be the commissioners of the joint commission; and 15 WBBRBAS the City of Carlsbad reaffirms the need for a 16 Housing Authority without effecting tbe previous 17 declaration; and 18 WBERBAS the City of Carlsbad declares that a Housing 19 Commission formed pursuant to Health and Safety Code Section 20 34291 is necessary for the implementation and formation of 21 various housing programs, 22 •ow 'l'BBRBPORB, the City Council of the City of 23 Carlsbad, does ordain as follows: 24 SECTION 1: Chapter 2.40 of Title 2 of the 25 Carlsbad Municipal Code is repealed and a new Chapter 2.40 26 is added to read as follows: 27 28 l 2 3 4 5 6 7 sections: 2.40.010 2.40.020 2.40.030 2.40.040 2.40.050 2.40.060 "Chapter 2.40" -HOUSING COMMISSION Established. Membership. Qualifications. Meetings. Vote required. Functions. 2.40.010 Established. Pursuant to Section 34291 of the 8 California Health and Safety Code, a Housing Commission is 9 created as an advisory body to the City Council and Housing 10 and Redevelopment Commission. 11 2.40,020 Membership. The Housing Commission shall 12 consist of seven (7) members. The members shall be appointed 13 by the Mayor and confirmed by the City Council. After the 14 initial term, the members shall serve four year terms with 15 the exception of the Planning Commission member who shall 16 serve a two year term; and each member shall serve until 17 their successor is duly appointed and qualified. The 18 initial members of the Commission shall serve staggered 19 terms as follows: 20 1. The Planni_ng Commission member shall serve for a 21 period of two (2) years; 22 2. Three members shall serve for a period of three 23 (3) years; and, 24 3. Three members shall serve for a period of four (4) 25 years. 26 Members shall serve without compensation. In addition, two (2) members of the Housing Commission shall be tenants assisted by the Carlsbad Housing Authority, one (1) of which shall be at least 62 years of age. One (1) member shall be a member of the Planning Commission. The remaining four (4) members shall, to the extent possible, have experience and expertise within one or more of the following areas: development, construction, real estate, social services, housing advocacy, planning, architecture and/or finance. the extent possible, the commission members shall be representative of the four quadrants of the City. To If a tenant member ceases to be a tenant assisted by the Authority and a non-tenant member ceases to reside, work or own a business or property within the city limits of the city of Carlsbad, his/her membership on the Commission shall terminate and another member shall be appointed for the remainder of the unexpired term. 2,40,040 Meetings. The Housing commission shall meet regularly, on days and times established by the commission for the transaction of business. The Commission may adjourn any regular meeting to a time and place specified at the regular meeting and any such adjourned meeting shall be deemed a regular meeting. The Housing Commission shall 1 2 3 4 elect from among its appointed members a chairman and vice- chairman. The.rules and procedures of the Planning Commission shall be modified, as necessary, and approved by the Housing Commission for the conduct of its business. 2.40,050, Vote required, Four members of the Housing 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 • 22 23 24 25 26 27 28 Commission shall constitute a quorum. The affirmative vote of_ four members shall be necessary for any action by the Commission. 2.40,060 Functions, The Housing commission shall advise and make reco1t1Jnendations to the Housing and Redevelopment Commission and/or the City Council as either body may request, including but not limited to the following: • establishment or amendment of affordable housing programs, policies and regulations; • • • establishment or implementation of affordable housing agreements; and review of affordable housing projects including project concept; affordability objectives; and, requests for City participation or incentives; and the Commission shall annually report to the City Council on the status and progress of affordable housing programs. Where appropriate, and particularly with respect to affordable housing projects, the Housing Commission shall provide its advice to and coordinate its reviews with the Planning Commission. For purposes of the Housing 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26· 27 28 Commission, an affordable housing project shall be defined as a project that provides housing to households of lower income or below as defined by the Housing Element of the General Plan, and proposes use of City-provided development incentives. EFFECTIVE DATE: The ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. NS-242 • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 2, CHAPTER 2. 40 OF THE CARLSBAD MUNICIPAL CODE BY AMENDING SECTIONS 2.40.020, 2.40.030 AND 2. 40. 050 ESTABLISHING A NINE MEMBER HOUSING COMMISSION AND ESTABLISHING QUALIFICATIONS FOR ITS MEMBERS, WHEREAS, the .city Council determined at its meeting of May 18, 1993 that the City's needs could best be fulfilled by a nine member Housing Commission rather than a seven member Housing Commission; and WHEREAS, Carlsbad Municipal Code Section 2.08.090 establishes uniform requirements for qualifications for an appointment to any city board, commission or committee that the applicant be a resident of the City of Carlsbad and a registered voter, NOW, THEREFORE, the City Council of the City of Carlsbad, does ordain as follows: SECTION I: That Title 2, Chapter 2.40 of the Carlsbad Municipal Code is amended by the amendment of Section 2.40.020 to reao. as follows: 11 2.40.020 Membershie The Housing Commission shall consist of nine (9) members. The members shall be appointed by the mayor and confirmed by the city Council. After the initial term, the members shall serve four year terms with the exception of the Planning Commission member who shall serve a two year term; and each member shall serve until their successor is duly appointed and qualified. The initial members of the Commission shall serve staggered terms as follows: (1) The Planning Commission member shall serve for a period of two (2) years; (2) Four (4) members shall serve for a period of three (3) years; and (3) Four (4) members shall serve· for a period of four (4) years. To the extent possible, the Commission members shall be representative of the four quadrants of the City.
