I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5670 APPROVING Conditional Use Permit Amendment CUP 17(B), based on the findings and subject to the conditions contained therein. II. INTRODUCTION The applicant, North Coast Christian Fellowship, is requesting approval for expansion through authorization to install two modular classroom buildings on the existing church property at 3254 Eureka Place. The modulars are 1,152 and 600 square feet respectively. The church site plan and buildings were first approved by Conditional Use Permit (CUP 17) in May 1968. An amendment to that approval, CUP l 7(A), was granted by the Planning Commission in June 1987 to construct a 1,350 square foot classroom building. The church requires additional classroom space to satisfy the needs of the current congregation and has therefore proposed a second amendment to the Conditional Use Permit (CUP) to increase classroom space through the use of two modular buildings. III. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting authorization to install one 24 foot by 48 foot modular building and one 12 foot by 50 foot modular building on property at 3254 Eureka Place. The buildings are intended to provide additional classroom space for the existing congregation. The 1.5-acre site is currently improved with a 2,100 square foot church building and a permanent 1,350 square foot classroom building. The remainder of the site is either parking or landscaped area. There is residential development to the north, east and south on adjacent lots. The buildings are proposed on the south side of the property where there are no existing improvements. The buildings will be installed on pier foundations. The hours of expected use of the buildings is daytime on weekends and possibly some use on weekday evenings. One-Family Residential (Chapter 21.10 of the Zoning Ordinance); C. Parking (Chapter 21.44 of the Zoning Ordinance); and D. Conditional Uses (Chapter 21.42 of the Zoning Ordinance). IV. ANALYSIS Staff developed its recommendation for approval after analyzing the project's consistency with the applicable City regulations listed above. A discussion on the compliance with each of the regulations follows: A. General Plan The property has a land use designation of Residential Medium Density (RM). Facilities for places of worship and a range of other community-serving activities are not traditional residential uses; nevertheless, these activities and land uses are important and traditional members of any vital and fully functioning community. It is therefore appropriate and encouraged by the General Plan that such uses are a part of residential neighborhoods. The church was first approved in 1968 and the first classroom addition was approved by the Planning Commission in 1987. Both of these previous approvals were assessed and determined to be consistent with the goals and intent of the General Plan. The addition of two modular classrooms can also be found to be consistent with the objective of providing for the social and spiritual needs of the community. B. One-Family Residential Churches and church related buildings are permitted in the R-1 zone by CUP. Any development within the R-1 zone is subject to the zone's development standards. The applicable standards for this project are limited to setbacks, lot coverage, and building height. The project will not affect the required front or rear yards. The minimum required side yard setback in this case is 10 feet. The project is proposed with a 15 foot and 27 foot setback from the property line and therefore satisfies the standard. A maximum of 40% of the lot may be covered by structures. The addition of the modular buildings to the site results in a total project lot coverage of approximately 8%. The maximum height for a structure with a flat roof is 24 feet. The height of the modular buildings once installed will be 14 feet and therefore consistent with the standard. The project is consistent with the development standards of the R-1 Zone. C. Parking All development must provide parking as required by Section 21.44 of the Zoning Ordinance. In the case of churches, the parking requirement is determined by the area of assembly and in CUP 17(B) -NORTH COAg CHRISTIAN FELLOWSHIP 0 November 3, 2004 Pae 3 addition, if classrooms are proposed, by the number of teachers for each elementary school classroom. The existing church is approximately 2,100 square feet. The parking required is one space per 100 square feet; therefore, 21 parking stalls are required for the church. With the addition of the two modular classrooms, there will be three onsite classroom buildings. The applicant projects a worst case of 5 teachers for the three buildings, therefore five spaces are required for the three classrooms. To meet all of the required parking standards, the project must provide 26 onsite parking stalls. There are 48 parking stalls available onsite. The project satisfies the standard for required onsite parking. D. Conditional Uses Expansion of the church may be permitted by a CUP as described in Chapter 21.42 of the Carlsbad Zoning Ordinance if the required findings can be made. It must be found that the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan, and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is located. Churches are a desired component of a residential neighborhood and the modular classrooms will offer space for educational purposes, which is typical of church uses. The site for the intended use must be adequate in size and shape to accommodate the use. In this case the modular buildings are located on the property in observance of all required permanent structure setbacks and height limitations. In addition, the total building coverage for the site is approximately 8% when a 40% lot coverage is permitted. Furthermore, all the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood must be provided and maintained. The project includes a new fence and landscaping that are intended to help reduce any visual intrusion that the buildings may have on the residential development to the south. The street system serving the proposed use must be adequate to properly handle all traffic generated by the proposed use. There will be a minimal impact on the adjacent and surrounding streets since the additional building area will only generate 15 Average Daily Trips (ADT). Cumulatively the existing church and facilities plus the additional classrooms will result in an ADT of 63. The first amendment to CUP 17 was granted for a period of 30 years. Because the City no longer assigns approvals for such long periods of time, the recommended condition No. 12 of Planning Commission Resolution No. 5670, assigns an approval period of 13 years and allows for 5 year extensions. The rationale is that 13 years is the period remaining of the 30 years previously granted by the Planning Commission in 1987. CUP 17(B) -NORTH co£ CHRISTIAN FELLOWSHIP November 3, 2004 Pa e4 V. ENVIRONMENTAL REVIEW 0 The proposed project is Class 1 Categorically Exempt from the California Environmental Quality Act (CEQA) as an existing facility. Section 15301 describes projects that fall into this category as additions to existing structures that are no greater than 2,500 square feet or 50% of the existing structures (whichever is less). The two modular buildings proposed are approximately 1,056 and 600 square feet respectively for a total of 1,656 square feet. The existing facilities are 3,450 square feet altogether. The proposed addition is both less than 50% in size of the existing facilities and is less than 2,500 square feet. No further environmental analysis is necessary.
