AGENDA OF: December 7, 2011 ltemNo. G) Application complete date: October 3, 2011 Project Planner: Dan Halverson Project Engineer: David Rick SUBJECT: CUP 00-36xl{A) -AT&T LA COSTA RESIDENCE WCF -Request for an amendment to Conditional Use Permit No. CUP 00-36xl to allow for the addition of three (3) additional new panel antennas, a new GPS antenna, and two (2) new equipment cabinets to an existing unmanned Wireless Communications Facility (WCF) consisting of a 240 square foot at grade equipment room and six (6) panel antennas mounted within two expanded chimney structures and one faux chimney located on a single family dwelling unit at 7512 Cadencia Street and in Local Facilities Management Zone 6. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6851 APPROVING an amendment to CUP 00-36xl based upon the findings and subject to the conditions contained therein. II. INTRODUCTION This proposed amendment to CUP 00-36x 1 will allow the addition of three (3) additional new panel antennas, one new GPS antenna, and two (2) new equipment cabinets to an unmanned Wireless Communication Facility (WCF) consisting of a 240 square foot at grade equipment room and six ( 6) existing panel antennas mounted within two expanded chimney structures and one faux chimney located on a single family dwelling unit at 7512 Cadencia Street. III. PROJECT DESCRIPTION AND BACKGROUND On May 16, 2001, CUP 00-36 was denied by the Planning Commission based on neighborhood opposition to the proposed use. The applicant filed a timely appeal to the City Council and on October 16, 2001, the City Council upheld the denial of CUP 00-36. AT&T commenced litigation in November 2001 in the Federal District Court in San Diego challenging the City Council's denial. The City Council denial was overturned. As a result, on December 9, 2003, the City Council adopted City Council (CC) Resolution No. 2003-325 approving CUP 00-36 based upon the court order. On July 15, 2009, the Planning Commission recommended approval to extend the permit retroactively from January 17, 2009 to January 16, 2019. Whereas the City Council subsequently on September 15, 2009 approved the extension of CUP 00-36. CUP 00-36x 1 (A) -AT&T LA COSTA RESIDENCE WCF December 7, 2011 Pae 2 The applicant (AT&T) is requesting to amend CUP 00-36xl to allow for the addition of three (3) additional new panel antennas, one new GPS antenna, and two (2) new equipment cabinets to an existing unmanned Wireless Communication Facility consisting of an existing 240 square foot at grade equipment room and six (6) existing panel antennas measuring 4'6" in height within two expanded chimney structures and one faux chimney located on this residence. The proposed panel antennas are comparable in size (4'6"x 6") to the existing panel antennas (4'6" x 5") and one new antenna is proposed to be located in each of the existing three chimneys. A new small OPS antenna will also be included in the equipment enclosure. Currently, the existing 1.07 acre hillside site is developed with a single family residence. The residence is three levels as seen from Cadencia Street and is setback from the street approximately 100 feet. The two operational chimneys have been expanded and house five antennas (three in one chimney and two in the other) while the faux chimney has one antenna. The antennas are screened within the chimneys and cannot be seen from public views. The equipment room is located adjacent to and right of the 400 square foot garage. The WCF is located in a P-C "residential" zone. Residential zones are considered "discouraged locations" under the City Council Policy #64 Guidelines. However, WCFs may be located in "discouraged locations" if the applicant demonstrates that no feasible alternative site exists within a preferred location. The applicant has submitted coverage maps indicating the coverage needs for this facility (see Attachment 8). The areas requiring coverage are residential. The applicant has demonstrated that there are no other properties within the vicinity that have a non- residential land use designation and are at a high enough elevation to meet the required WCF coverage objectives as the existing site. The design guidelines of City Council Policy # 64 require that all aspects of a WCF, including the supports, antennas, screening methods, and equipment should exhibit "stealth" design techniques so they visually blend into the background or the surface onto which they are mounted. The policy encourages collocation wherever feasible and appropriate. Consistent with this, the proposed antennas and equipment will be collocated on the existing residence. The project complies with the policy design guidelines in that the facility is a "stealth" design. Specifically, the existing as well as proposed panel antennas are located within two expanded chimneys and one faux chimney. The WCF existing and proposed equipment is located within a 240 square foot room that was built adjoining the 400 square foot garage. The applicant submitted an RF emissions report to ensure that the RF emissions will not exceed the FCC guidelines. The report indicates that the RF emissions of the existing and proposed AT&T Wireless antennas will be well below the FCC standard for continuous public exposure. The project complies with City Standards and all necessary findings can be made for the approval being requested. IV. ANALYSIS The proposed Wireless Communication Facility continues to be consistent with all applicable plans, policies and regulations described below: A. The Carlsbad General Plan; CUP 00-36xl(A)-AT&T LA COSTA RESIDENCE WCF December 7, 2011 Pae 3 B. Planned Community (P-C) Zone (Chapter 21.38 of the Carlsbad Municipal Code) and The La Costa Master Plan (MP 149); C. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); D. City Council Policy Statement: Policy# 64-Wireless Communication Facilities; and E. Growth Management Ordinance (Chapter 21.90 of the Zoning Ordinance) and Zone 6 Local Facilities Management Plan. The recommendation for approval of this project was developed by analyzing the project's consistency with the applicable regulations and policies. The project's compliance with each of the above regulations is discussed in the sections below. A. The City of Carlsbad General Plan The project complies with the General Plan in that, the use is necessary and desirable for the development of the community because of the benefit and demand for digital communications and data transmissions for businesses, individuals, public agencies and emergency service systems in this part of the city. The use is consistent with the General Plan in that the Residential Low-Medium Density (RLM) General Plan Land Use designation does not preclude the provision of Wireless Communication Facility (WCF) uses. Additionally, the proposed antennas will be screened inside the existing chimneys and the equipment in the existing equipment room. Therefore, the project's stealth design complies with the General Plan objectives that seek to maintain and enhance Carlsbad's appearance. B. Planned Community (P-C) Zone (Chapter 21.38 of the C.M.C) and The La Costa Master Plan (MP 149) In the P-C Zone, the permitted uses and structures shall be established by a master plan of development approved in accordance with Chapter 21.38 of the C.M.C. The master plan may include any use found to be necessary and desirable for a community plan. The La Costa Master Plan does not preclude the provision of Wireless Communication Facility (WCF) uses and the proposed antennas will be screened inside the existing chimneys and the equipment in the existing equipment room. The existing WCF antennas are located within the .two operational chimneys and one faux chimney and are not within any of the required front, rear or side yard setbacks. The two (2) new equipment cabinets will be located within the existing equipment room and also meet all development .standards of the La Costa Master Plan. The required CUP findings ( discussed below in Section C) can be made for the proposed WCF as it is a desirable public convenience and is compatible with its surroundings. C. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code) Conditional uses, such as WCFs possess unique and special characteristics that make it impractical to include them as permitted uses "by right" in any of the various zoning classifications (i.e. residential, commercial, office, industrial). The authority for the location and operation of these uses is subject to Planning Commission review and the issuance of Conditional Use Permits. Staff has reviewed the proposed project and found that all the CUP 00-36x 1 (A) -AT&T LA COST A RESIDENCE WCF December 7, 2011 Pae 4 necessary finding can be made to approve the CUP Amendment. The required findings and satisfaction of these findings are discussed below in Table A. TABLE A -CONDITIONAL USE PERMIT FINDINGS FINDINGS That the requested use is necessary or desirable for the development of the community, and is in harmony with the various elements and objectives of the general plan, including, if applicable, the certified local coastal program, specific plan or master plan. That the requested use is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. PROJECT CONSISTENCY The requested amended WCF use is necessary and desirable for the development of the community because of the benefit and demand for digital communications and data transmissions for businesses, individuals, public agencies and emergency service systems in this part of the city. The use is consistent with the General Plan in that the Residential Low-Medium Density (RLM) General Plan Land Use designation does not preclude the provision of Wireless Communication Facility (WCF) uses. Additionally, the proposed antennas are the same size and shape as the existing antennas and will be screened within two operational chimneys and one faux chimney. The new equipment cabinets will be located in the existing equipment room that is designed to match the existing residence. Therefore, the project's stealth design complies with the General Plan objectives that seek to maintain and enhance Carlsbad's appearance. The requested addition to the existing WCF to locate three new antennas within three chimneys and two new equipment cabinets within an existing equipment shelter is not detrimental to existing uses, or to uses permitted in the zone in that the amended project is stealth in design and the WCF use is not precluded by the project site's P-C Zoning or La Costa Master Plan. Furthermore, the placement of additional antennas within the two operational chimneys and one faux chimney and two (2) new equipment cabinets in the existing equipment room will not result in any additional building coverage, does not visually impact the existing site, and the WCF does not interfere with other surrounding uses. The project also complies with the Federal Communications Commission (FCC) Radio Frequency (RF) Exposure Guidelines. CUP 00-36x 1 (A) -AT&T LA COSTA RESIDENCE WCF December 7, 2011 Pae 5 TABLE A -CONDITIONAL USE PERMIT FINDINGS CONTINUED FINDINGS That the site for the proposed conditional use is adequate in size and shape to accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other development features prescribed in this code and required by the Planning Director, Planning Commission or City Council, in order to integrate the use with other uses in the neighborhood. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. PROJECT CONSISTENCY The site for the proposed conditional use is adequate in size and shape to accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other development features prescribed in this code in that the existing chimneys which the proposed antennas are to be located in are not within any of the required front, rear or side yard setbacks. The two (2) equipment cabinets located within the existing equipment room also meets all development standards. The unmanned WCF use requires, on average, only monthly maintenance visits and occasional visits in response to operational problems. The existing street system is adequate to properly handle any traffic generated by the use. D. Wireless Communication Facilities Ordinance (City Council Policy 64) The City Council adopted a policy (Policy # 64) regarding prioritization for the location of Wireless Communication Facilities (WCF) within the City on October 3, 2001 (Last revised July 14, 2009). The guidelines state that WCFs should be located on buildings and structures, not on vacant land. In addition, preferred locations of WCFs, in order of priority, are industrial, commercial, public, other non-residential, public utility, park, or community facility property. The WCF is located in a P-C "residential" zone. Residential zones are considered "discouraged locations" under the City Council Policy #64 Guidelines. However, WCFs may be located in "discouraged locations" if the applicant demonstrates that no feasible alternative site exists within a preferred location. The report, dated June 16, 2011, indicates that the RF emissions of the existing and proposed AT&T Wireless antennas will be below the FCC standard for continuous public exposure. E. Growth Management Ordinance (Chapter 21.90 of the Zoning Ordinance) and Zone 6 Local Facilities Management Plan. The proposed site is located within Local Facilities Management Plan Zone 6. The installation of additional antennas within the existing chimneys and two (2) new equipment cabinets within the existing equipment shelter would not result in increased public facilities demands and therefore, the project would not exceed performance standards for public facilities. V. ENVIRONMENTAL REVIEW The Planning Director has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301(e), "Additions to Existing Structures", of the State CEQA Guidelines and will not have any adverse significant impact on the environment. • ATTACHMENTS: 1. That based on the evidence presented at the public hearing, the Planning Commission RECOMMENDS APPROVAL OF AT&T 7512 CADENCIA - CUP 00-36xl based on the following findings and subject to the following conditions: Findings: 1. 2. 3. The adopted findings for CUP 00-36 which are contained in City Council Resolution No. 2003-325 apply to this extension and are incorporated by this reference. That the Planning Director has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301, Existing Facilities, of the state CEQA Guidelines. In making this determination, the Planning Director has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. That the existing Wireless Communication Facility (WCF) remains consistent with the location and design guidelines of City Council Policy No. 64, in that although the facility is located within the Planned Community (P-C) residential zone, a "discouraged" location, the applicant bas demonstrated that no feasible alternative site currently exists within a "preferred" location that can achieve the required WCF coverage objectives as its current location. Furthermore, the existing Wireless Communication Facility exhibits "stealth" design through locating a 240 square foot Radio Base System (RBS) in a garage and concealing six (6) panel antennas within two extended chimneys and Qne faux chimney. Conditions: 1. No vested rights are gained by Developer or a successor in interest by the City's approval of this Conditional Use Permit Extension. All conditions of approval imposed upon Conditional Use Permit CUP 00-36 as stated in City Council Resolution No. 2003-325 shall apply as conditions of approval for CUP 00- 36x 1 and are incorporated by this reference, except Planning ·Conditions No. 6, 8, 9, 11 and 14, which have been satisfied and Planning Condition No. 7, which is superseded by Condition No. 4 below. Conditions of approval No. 3, 5, 6 and 7 below are new conditions. This Conditional Use Permit shall be reviewed by the Planning Director on a yearly basis to determine if all conditions of this permit have been met and that the use does not have a substantial negative effect on surrounding properties or the public health and welfare. If the Planning Director determines that the use has such substantial negative effects, the Planning Director shall recommend that the Planning Commission, after providing the permittee the opportunity to be heard, add additional conditions to reduce or eliminate the substantial negative effects. This Conditional Use Permit Extension is granted r-etroactively for a period of ten years from January 17, 2009 through January 16, 2019. This permit may be revoked at any time after a public hearing, if it is found that the use has a substantial detrimental effect on surrounding land uses and the public's health and welfare, or the conditions imposed herein have not been met. This permit may be extended for a reasonable period of time not to exceed ten years upon written application of the permittee made no less than 90 days prior to the expiration date. The Planning Commission may not grant such extension, unless it finds that there are no substantial negative effects on surrounding land uses or the public's health and welfare. If a substantial negative effect on surrounding land uses or the public's health and welfare is found, the extension shall be denied or granted with conditions which will eliminate or substantially reduce such effects. There is no limit to the number of extensions the Planning Commission may grant. All landscaping shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 6. Developer shall submit to the City a Notice of Restriction executed by the owner of the real property to be developed. Said notice is to be filed in the office of the County Recorder, subject to the satisfaction of the Planning Director, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Conditional Use Permit Extension by Resolution No. 6600 on the property. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. The Planning Director has the authority to execute and record an amendment to the notice which modifies or terminates said notice upon a showing of good cause by the Developer or successor in interest. Engineering: 7. Developer shall comply with the City's Stormwater Regulations, latest version, and shall implement best management practices at all times. Best management practices include but are not limited to pollution treatment practices or devices, erosion control to prevent silt runoff during construction, general housekeeping practices, pollution prevention and educational practices, maintenance procedures, and other management practices or devices to prevent or reduce the discharge of pollutants to storrnwater, receiving water or stormwater conveyance system to the maximum extent practicable. .. This Conditional Use Permit is granted for a period of 5 years from its effective 4 date._ This permit may be revoked at any time after a public hearing; if it is found that the use has a substantial detrimental effect on surrounding land uses and 5 the public's health and welfare, or the conditions imposed herein have not been met. This permit may be extended for a reasonable period of time not to exceed 6 5 years upon written application of the permittee made no less than 90 days prior to the expiration date. Within six (6) months after the issuance of occupancy, the Developer/Operator shall submit a project implementation report which provides cumulative field measurements of radio frequency (EMF) power densities of all antennas installed at the subject site. The report shall quantify the EMF emissions and compare the results with currently accepted ANSI/IEEE standards. Said report shall be subject to review and approval by the Planning Director for consistency with the Project's preliminary proposal report and the accepted ANSI/IEEE standards. If on review, the City finds that the Project does not meet ANSI/IEEE standards, the City may revoke or modify this conditional use permit. 14.
