AGENDA OF: April 3, 2002 ItemNo.@ Application complete date: February 5, 2002 Project Planner: Barbara Kennedy Project Engineer: David Rick SUBJECT: CUP 01-24/SUP 01-07/CDP 01-33 -MARJA ACRES PCS FACILITY - Request for approval of a Conditional Use Permit, Special Use Permit, and Coastal Development Permit to allow an unmanned telecommunications facility consisting of modifications to an existing equipment area and installation of four (4) panel antennas on an existing mono-palm structure. The site is located at 4901 El Camino Real in the C-2 and R-A-10 zones in Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 5163, 5164, and 5165 APPROVING CUP 01-24, SUP 01-07, and CDP 01-33 for a period of five (5) years, based on the findings and subject to the conditions contained therein. II. INTRODUCTION This application is a request for a Conditional Use Permit, Special Use Permit, and Coastal Development Permit to allow an unmanned, telecommunications facility consisting of a freestanding equipment building and four panel antennas mounted within the trunk of a previously approved 30 foot tall mono-palm. Quasi-public utility facilities are permitted in residential and commercial zones by a conditional use permit and all required findings for the Conditional Use Permit, Special Use Permit and Coastal Development Permit can be made for the proposed facility. III. PROJECT DESCRIPTION AND BACKGROUND Sprint PCS (formerly Cox) currently operates a telecommunications facility on the site under CUP 96-05/HDP 96-07/SUP 96-05, which was approved December 4, 1996 and expired December 4, 2001. Sprint's existing facility consists of six panel antennas mounted on individual poles and an equipment room surrounded by a block wall near the base of the slope behind the commercial buildings. The new application was submitted prior to the expiration of the existing CUP and would replace CUP 96-05/HDP96-07/SUP 96-05. The site supports two other telecommunications facilities. PacBell has a monopole structure which is currently under review for an extension to their CUP. Also, Nextel recently received approval for a mono-palm structure. In order to reduce the visual clutter of multiple carriers on the site, the City required Nextel to design the mono-palm so that a second carrier could co- locate on their facility. Nextel and Sprint have been working together closely to ensure that the mono-palm will be designed to meet the needs of both carriers. Building permits were issued for the mono-palm in October 2001 and construction of this facility is nearing completion. -CUP 01-24/SUP 01-07/Co9cn-33-MARJAACRES PCS FACIL~f April 3, 2002 Pa e2 Sprint's proposal would consist of four panel antennas mounted within the trunk of the 30 foot faux palm tree (mono-palm). The existing 375 square foot equipment area would be redesigned to complement the exterior building materials and color of the adjacent commercial buildings, similar to the proposal approved for the Nextel facility. The equipment area would remain in its current location just south of the Nextel equipment. Sprint will also be constructing a trash enclosure adjacent to the equipment building for use by the Marja Acres center. The six poles which support the existing antennas would be removed upon relocation of the antennas to the mono-palm. Sprint PCS is a Personal Communications System (PCS) company and is a public utility licensed to operate in California by the Federal Communications Commission (FCC). PCS technology has emerged as an important emergency response service and business tool, as well as being convenient for business and family use. The network is similar to a cellular telephone network with digital technology improving on the sound quality of cellular. IV. ANALYSIS The proposed project is subject to the following regulations: A. Residential Agriculture (R-A-10) and General Commercial Zone (C-2) (Chapters 21.08 and 21.28 of the Carlsbad Municipal Code); B. Scenic Preservation Overlay Zone (Chapter 21.40 of the Carlsbad Municipal Code); C. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); D. City Council Policy Statement: Policy 64 -Wireless Communication Facilities; E. Coastal Development Regulations (Chapter 21.201 of the Zoning Ordinance); and F. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code). The recommendation for approval of this conditional use permit, special use permit and coastal development permit was developed by analyzing the project's consistency with the applicable City regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A. Residential Agriculture (R-A-10) and General Commercial Zone (C-2) Chapter 21.42.010(2)(J) (Conditional uses) allows accessory public and quasi-public buildings and facilities in all zones, including the C-2 commercial and R-A-10 residential zones with approval of a conditional use permit. The equipment cabinet will be located on the C-2 zoned portion of the site. The enclosure complies with all applicable restrictions of the C-2 zone. The proposed antennas will be located within the trunk of the previously approved mono-palm on the R-A-10 zoned portion of the site. Again, the project complies with all applicable regulations of the R-A-10 zone, in that the pole is not located within any required setback area and the antennas will be located within the pole structure. .. Scenic Preservation Overlay Zone The proposed antennas will be located approximately 300 feet from El Camino Real, which has been designated a Scenic Roadway by the City's General Plan. Consequently, the project is subject to the requirements of the El Camino Real Scenic Corridor Development Standards and requires a Special Use Permit. The view of the existing mono-palm is fairly distant since it is located slightly over 300 feet away from the roadway. The surrounding natural view shed is not considered significant due to the fact that it has been partially degraded by existing development between the project and El Camino Real, a mobile home park development to the east, utility poles and lines along El Camino Real, and SDG&E transmission towers to the west. To reduce the visibility of the installation, the antennas will be located within the trunk of the existing "stealth" mono-palm. Given that the previously approved mono-palm is a stealth design which was designed to blend into the landscape through the addition of other mature palms, and that the proposed antennas will be mounted in the trunk of the mono-palm and completely concealed, staff has concluded that the proposal conforms to the requirements of the Scenic Preservation Corridor Overlay. C. Conditional Use Permit Regulations Conditional uses such as cellular communications facilities possess unique and special characteristics which make it impractical to include them as permitted uses "by right" in any of the various zoning classifications (i.e., residential, commercial, office, industrial). The authority for the location and operation of these uses is subject to Planning Commission review and the issuance of conditional use permits. Staff has reviewed the proposed project and found that all the necessary findings can be made to approve the conditional use permit. The required findings and supporting facts are contained in Table 1, below. City Council Policy Statement: Policy 64 -Wireless Communication Facilities The City Council adopted policies regarding prioritization for the location of Wireless Communications Facilities (WCF) on October 3, 2001. The guidelines state that wireless facilities should be located on buildings and structures, not on vacant land. In addition, WCFs should locate, in order of priority, on industrial, commercial, public, other non-residential, public utility, park, or community facility property. Design guidelines of the policy state that all aspects of a WCF, including the supports, antennas, screening methods, and equipment should exhibit "stealth" design techniques so they visually blend into the background or the surface onto which they are mounted. The policy encourages co-location wherever feasible and appropriate. The project complies with this policy in that the existing Sprint antennas and support poles will be removed and the antennas will be relocated in the interior of the trunk of an existing mono- palm. The mono-palm was specifically designed to support a second carrier and it is surrounded by mature palms which help the installation to blend in with the natural surroundings. The removal of the existing facility and co-location onto the stealth faux palm will reduce the visual clutter of the numerous facilities on this site. Since there will be two carriers on the site, the applicant submitted an RF Emissions Analysis report to ensure that the combined RF emissions will not exceed the FCC's guidelines. The report indicates that the cumulative or combined power density of the Sprint and Nextel antennas that the general public would be exposed to standing at the base of the mono-palm is .2235 m W/cm2, which is 22.35% (MPE) or approximately one fourth the value of lm W/cm2 .. Coastal Development Regulations The site is located within the Mello II segment of the City's Coastal Zone and is subject to the corresponding land use policies and implementing ordinances. These policies and ordinances emphasize topics such as preservation of agriculture and scenic resources, protection of environmentally sensitive resources, provision of shoreline access, and the prevention of geologic instability and erosion. The commercial portion of the site is currently developed and the proposed equipment building and trash enclosure will be located adjacent to an existing drive aisle and will be surrounded by landscaping. The mono-palm is located on a small portion of the Residential-Agricultural zoned land however, these lands are not designated as coastal agricultural lands. The proposed facility will not affect the existing agricultural and residential uses on the site. No environmentally sensitive lands exist on site. Since the project site is located over two miles from the Pacific Ocean, no shoreline development regulations apply. Since the project site is located within 300 feet of El Camino Real which is designated as a Scenic Corridor, the Scenic Preservation Overlay Zone standards apply to the project and are analyzed in the previous section. Given the above, the project is consistent with the Mello II land use policies and the applicable implementing ordinances. F. Growth Management The site is located within Local Facilities Management Zone 1. The installation of the four panel antennas on a previously approved mono-palm and redesign of the existing equipment room will not result in increased public facilities demands; therefore, the proposal will not exceed performance standards for public facilities. V. ENVIRONMENTAL REVIEW The construction and installation of small new equipment facilities or structures is a Class 3 Categorical Exemption under the California Environmental Quality Act (Guidelines Section 15303). The FCC requires compliance with radio frequency power density standards (ANSI/IEEE C95.l-1992) for the general public, therefore, the project would not have a significant impact on the environment.
