RECOMMENDATION 1. Hoehn Motors Signs: Staff recommends that a Conditional Use Permit for one additional free- standing sign be APPROVED (as opposed to the two additional signs re- quested), because of the following findings and subject to the following conditions: FINDINGS 1) The requested use is desirable for the development of the Community, is in haromony with the General Plan, and is not detrimental to existing or permitted uses in the zone in which the proposed use is to be located because: a) Additional sign advertising will enhance the commercial viability of the site; and b) The additional sign will not detract from the overall visual appearance of the auto center. 2) The site for the intended use is adequate to accommodate the use because: a) The width of the site (481 feet) is great enough to absorb an additional freestanding sign in addition to the existing sign without creating an undesirable clutter of signing. 3) All yards, setbacks and other features necessary to adjust the re- quested use to existing or permitted future uses in the neighbor- hood will be provided and maintained because: a) All such features are guaranteed through conditions of approval. -1- 4) The street system serving the proposed use is adequate to prop- erly handle all traffic generated by the proposed use because: la) Paseo del Norte, Cannon Road, and Palomar Airport Road are all designed to handle the volume of traffic generated by the auto center, of which the additional sign is a part. 5) The proposed sign is appropriate for the use of the property and compatible with the design of the development and adjacent prop- erties, and will not adversely affect the appearance of the area because: a) The sign's copy is of an automotive nature, appropriate for a car dealer in an auto center. 6) The proposed sign will not interfere with the safety of the travel- ing public or restrict any views because: a) The sign is not of a size or bulk large enough to distract drivers or impede views of the hills to the east of the pro- ject site. 7) The proposed sign will not result in a proliferation of signs in the area because: a) The width of the project site will not allow additonal free- standing signs under the terms of section 21.41.075 (b). b) Attached signing is limited by section 21.41.070. 8) The project has complied with the requirements of the Carlsbad Environmental Protection Ordinances as a Categorical Exemption (Section 19.05.090-C5) because: a) The proposed sign constitutes a minor appurtenance to an existing commercial facility. CONDITIONS! 1 ) T he a p p r o v a l i s granted f o r th e l an d d e s c r i bed i n t h e a p p 1 i cat i on and attachments thereto, for one of the two signs shown on Exhibit A, dated December 9, 1976. 2) The l o cation of the sign on the l o t sh al l conform to a 11 1 o cation al requirements of section 21.41.075 (b), C.M.C. The Planning Director shall determine conformity with that section prior to approval of a sign permit. 3) All signs on the project site shall conform to the requirements of Chaper 21.41 (Signs) of the Carlsbad Municipal Code. The erection of non-conforming signs shall be considered a breach of this approval. 4) This Conditional Use Permit shall automatically terminate concurrent with termination of use of the site for an Oldsmobile dealership -2- 2. (if the Oldsmobile sign is used) or for a Honda dealership (if the Honda sign is used). Toyota of Carlsbad signs: Staff recommends that a Conditional Use Permit for an additonal free- standing be APPROVED because of the following findings and subject to to the following conditions: FINDINGS 1) The requested use is desirable for the development of the Community, is in harmony with the General Plan, and is not detrimental to existing or permitted uses in the zone in which the proposed use is to be located because: a) Additional sign advertising will enhance the commercial viability to the site; and b) The additional sign will not detract from the overall visual appearance of the auto center. 2) The site for the intended use is adequate to accommodate the use because: a) The width of the site (329 feet) is great enough to absorb an additonal freestanding sign without creating an undesirable clutter of signing. 3) All yards, setbacks and other features necessary to adjust the re- quested use to existing or permitted future uses in the neighborhood will be provided and maintained because: a) All such features are guaranteed through conditions of approval. 4) The street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use because: la) Paseo del Norte, Cannon Road, and Palomar Airport Road are all designed to handle the volume of traffic generated by the auto center of which the additional sign is a part. 5) The proposed sign is appropriate for the use of the property and compatible with the design of the development and adjacent prop- erties, and will not adversely affect the appearance of the area be- cause: a) The sign's copy is of an automotive nature, appropriate for a car dealer in an auto center. 6) The proposed sign will not interfere with the safety of the traveling public or restrict any views because: -3- a) The sign is not of a size or bulk large enough to distract drivers or impede views of the hills to the east of the project site. 7) The proposed sign will not result in a proliferation of signs in the area because: a) The width of the project site will not allow additonal free- standing signs under the terms of section 21.41.075 (b). b) Attached signing is limited by section 21.41.070. 8) The project has complied with the requirements of the Carlsbad Environmental Protection Ordinances as a Categorical Exemption (Section 19.05.090-CS) because: a) The proposed sign constitutes a minor appurtenance to an existing commercial facility. CONDITIONS 1) The approval is granted for the land described in the application and attachments thereto, for the sign with copy "Toyota Parts & Service" as shown on Exhibit B, dated December 9, 1976. 2) The location of the sign on the lot shall conform generally to the location shown on Exhibit B, dated December 9, 1976, except that the exact location of the sign shall conform to all locational requirements of section 21.41.075 (b), C.M.C. The Planning Director shall determine conformity with that section prior to approval of a sign permit. 3) All signs on the project site shall conform to the requirements of Chapter 21.41 (Signs) of the Carlsbad Municipal Code. The erection of non-conforming signs shall be considered a break of this approval. 4) This Conditional Use Permit shall automatically terminate concurrent with termination of use of the site for a Toyota Dealership. 3. Rorick Buick-Opel Signs: Staff recommends that a Conditional Use Permit for an additional free- standing sign be APPROVED because of the following findings and subject to the following conditions: FINDINGS 1) The requested use is desirable for the development of the Community, is in harmony with the General Plan~ and is not detrimental to existing or permitted uses in the zone in which the proposed use is to be located because: -4- a) Additional sign advertising will enhance the commercial via- bility of the site; and b) The additional sign will not detract from the overall visual appearance of the auto center. 2) The site for the intended use is adequate to accommodate the use because: a) The width of the site (534 feet) is great enough to absorb an additonal freestanding sign without creating an undesirable clutter of signing. 3) All yards, setbacks, and other features necessary to adjust the requested use to existing on permitted future uses in the neigh- borhood will be provided and maintained because: a) All such features are guaranteed through conditions of approval. 4) The street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use because: la) Paseo del Norte, Cannon Road and Palomar Airport Road are all designed to handle the volume of traffic generated by the auto center, of which the additional sign is a part. 5) The proposed sign is appropriate for the use of the property and compatible with the design of the development and adjacent prop- erties, and will not adversely affect the appearance of the area because: a) The sign's copy is of an automotive nature, appropriate for a car dealer in an auto center. 6) The proposed sign will not interfere with the safety of the traveling public or restrict any views because: a) The sign is not of a size or bulk large enough to distract drivers or impede views of the hills to the east of the project site. 7) The proposed sign will not result in a proliferation of signs in the area because: 8) a) b) The width of the project site will not allow more than one freestanding sign under the terms of section 21.41.075 (b); Attached signing is limited by section 21.41.070. The project has complied with the requirements of the Carlsbad Environmental Protection Ordinances as a Categorical Exemption (Section 19.05.090-C5) because: a) The proposed sign constitutes a minor appurtenance to an existing commercial facility. -5- CONDITIONS 1) The approval is granted for the land described in the application. and attachments thereto, for the sign with copy "Used Cars Rorick Opel" as shown on Exhibit C, dated December 9, 1976. 2) The approval of this Conditional Use Permit constitutes approval of sign copy and the general location shown on Exhibit C, dated December 9, 1976. The approval shall become effective only upon Planning Commission a~proval of a site plan and Architectural Elevations for the Rorick dealership in conformance with Ordinance 9288, adopting a Specific Plan for the Car County area. The exact location of the sign shall conform to all locational requirements of section 21.41.075 (b), C.M.C, as c!.QQ.li~~ to the site plan adopted by the Planning Commission. The Planning Director shall determine conformity with that section prior to approval of a sign permit. 3) All signs on the project site shall conform to the requirements of Chapter 21.41 (Signs) of the Carlsbad Municipal Code. The erection of non-conforming signs shall be considered a break of this approval. 4) This Conditional Use Permit shall automatically terminate concurrent with termination of use of the site for an Opel dealership. BACKGROUND REPORT Location and Description of Property: The three project sites are located in Car Country, on the east of Paseo del Norte, between Cannon Road and Palomar Airport Road. Hoehn Motors is in operation on its site. The Planning Commission recently approved plans for a Toyota dealership on the second site. An appli- cation for approval of a Buick-Opel dealership has been received on the third site. The Council adopted an amendment to the Sign Code permitting additional free-standing signs, November 2, 1976 (Ordinance 8070) Environmental Impact Information: The projects are categorically exempt from the requirements of the Carlsbad Environmental Protection Ordinance as construction of minor appurtenances to existing commercial facilities. General Plan Information: The project site is designated in the Land Use Element for Extensive Regional Retail use. Public Facilities: Not Applicable Major Planning Consideration: Do the signs proposed meet the intent and requirements of the City's Sign Code? DISCUSSION Hoehn Motors: Two freestanding signs have been proposed in additon to the existing freestanding sign To meet the requirements of the Sign Code it would be necessary to have a total of 450 feet between the northern property and the existing sign (one sign 50 feet from that property line and 200 feet between each of the other signs). However, the existing sign is approximately 80 feet from the southerly property line. Therefore, the needed 450 ft. does not exist. Staff therefore has recommended approval of the copy of both signs, and approval of the location of one of these signs on the premises. In approving an additional freestanding sign the Commission should recognize the existence of various signs on the site. Two free- standing signs reading 11 Ho·nda 11 and 11 0ldsmobile 11 exist on the site. Each of these are 4.5 feet high and 5 square feet in area. It has been claimed that these signs are directional, and are therefore exempted from the Sign Code (21.41.060-3). These signs contain no arrows or other directional information, and staff therefore believes they are advertising signs subject to the requirements of the Code. If the Commission agrees with this interpretation, staff will require their removal in conformance with Condition #4. If the Commission interprets them as directional signs, then a Condition 5 should be added, Specifically exempting them. -7- In addition, there are various pennants and banners on the site. These are expressly prohibited by the Sign Code (Section 21.41.050-2), and staff will require their removal in conformance with Condition 4. Toyota and Rorick: Both of these proposals contain signs which exceed 20 feet in height. These Sif:lns cannot therefore be processed as 11 Additional" freestanding these signs are allowed by the right-----all parcels zoned commercially are entitled to one freestanding sign subject to the size and height limitations of the sign code. These signs require no action by the Commission, and can be handled through the City's regular sign permit procedures. The other signs proposed for these dealerships meets the requirements for additional freestanding signs and staff has therefore recommended their approval.
