AGENDA OF: September 6, 2000 ItemNo.@ Application complete date: April 5, 2000 Project Planner: Paul Godwin Project Engineer: David Rick SUBJECT: CUP 146{B)-CHURCH OF JESUS CHRIST-LDS -A request for approval of a Conditional Use Permit Amendment to allow for the construction of parking lot perimeter fences and gates around existing parking at the Church of Jesus Christ LDS site at 1975 Chestnut Avenue, generally located west of Monroe Street and east of Valley Street, in Local Facilities Management Zone I. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4832 RECOMMENDING APPROVAL of Conditional Use Permit Amendment CUP 146(B) based on the findings and subject to the conditions therein. II. INTRODUCTION The application is a request for approval to allow a series of 6' high fences and gates to secure existing parking lots and three parking lot entrances, in order to provide security and prevent vandalism and trespassing on the property. The project is in conformance with all applicable plans, standards, ordinances and policies. III. PROJECT DESCRIPTION AND BACKGROUND The applicant, Coombs Architecture and Planning, has requested permission to enclose 159 of the 194 existing parking spaces, at the Church of Jesus Christ LDS located at 1975 Chestnut Avenue, with a 6' high fence, as shown on Exhibit "A." The existing site includes three parking lot entrances, one from Magnolia A venue with an existing manual gate, one from Chestnut A venue and one from Monroe Street, both of which are presently ungated. There are existing brick and wood fences surrounding portions of the parking area. The proposed fences and gates would secure 159 of the 194 parking spaces, with the three existing access points remaining. The existing manual gate located at the Magnolia A venue entrance would remain, and an additional manual gate would be added approximately 120' back from the Monroe Street entrance to the church. By placing the Monroe Street gate back 120', 35 unenclosed parking spaces will remain at the front of the church. At the Chestnut Avenue entrance, dual gates with a key pad controlled entrance and an automatic exit device will be provided, as well as an override device to allow for emergency access. A vehicle turn around is provided in front of the Chestnut Avenue entrance gates. A 3' wide single-swing pedestrian gate will be provided in the Monroe Street and Chestnut A venue gates. 0 CUP 146(B)-CHURCH 0J:<' JESUS CHRIST-LOS September 6, 2000 Page2 The applicant's desire to enclose the parking areas stems from incidents of vandalism and trespassing, which have occurred on the site. The gates will remain open during all activities, events and services to prevent queuing of traffic on frontage streets. With all proposed gates secured, 35 unenclosed parking spaces will remain in the parking lot fronting Monroe Street, with two ungated points of access. A Conditional Use Permit (CUP 146) was approved for the Church of Jesus Christ LDS in 1977. This application will amend that approval to allow for the fencing and gating of 159 of the 194 provided parking spaces. The application is subject to the following regulations: A. City of Carlsbad General Plan: B. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); C. Growth Management Ordinance (Chapter 21.90 of the Carlsbad Municipal Code). IV. ANALYSIS The recommendation for approval of this project was developed by analyzing the project's consistency with the applicable policies and regulations listed above. The following analysis section discusses compliance with each of these regulations/policies utilizing both text and tables. A. GENERAL PLAN The General Plan land use designation for the subject site is Residential Low to Medium Density (RLM). The Church of Jesus Christ LDS has an existing Conditional Use Permit (CUP 146), which allows the church to operate on the subject site. Particularly relevant to the fencing and gating proposal are the Land Use, Circulation and Public Safety Elements of the General Plan. Table 1 below indicates how the project complies with these particular elements of the General Plan. Given the above, the Church of Jesus Christ LDS parking lot enclosure proposal is consistent with the applicable goals, programs, policies and objectives of the General Plan. B. CONDITIONAL USE PERMIT Conditional land uses such as churches possess unique and special circumstances which make it impractical to include them as permitted uses "by right" in any of the various zoning classifications. The authority for the location and operation of these uses is subject to Planning Commission review and approval. This application will amend an approved Conditional Use Permit to allow the installation of fences and gates to secure existing parking lots at the subject site. Also, a vehicle tum-around has been provided at the automatic gate on Chestnut A venue to allow cars to re-enter the street without having to back up. Thirty-five parking spaces will remain ungated to ensure that some parking and access is available at all times. C. GROWTH MANAGEMENT ORDINANCE The proposed site is located within Local Facilities Management Zone 1. The construction of parking lot fencing and gates on an existing church site will not result in increased public facilities demands and therefore, the project will not exceed performance standards for public facilities. V. ENVIRONMENTALREVIEW The Planning Director has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the State CEQA Guidelines and will not have any adverse significant impact on the environment.
