HomeMy WebLinkAbout1978-04-26; Planning Commission; ; CUP 149 - BROWN TRUCKINGSTAFF REPORT DATE: TO: FR.Of: March 22, 1978 Planning Connnission Planning Department SUBJECT: CUP 149, Brown Trucking Background Location and Description of Property The subject property is on approximately 92 acres owned by South Coast Asphalt Company, located on the south side of Haymar Drive, west of College Blvd. The property fronts on a private road used by South Coast Asphalt. The trucking operation and existing trailer is located at the northeast corner of the property on a triangular portion formed by Haymar Drive and the private road. Directly behind the trailer is uncovered storage of assorted equipment, fuel tanks, tires and lumber. West of the storage is a graded area where trucks and trailers are parked. The whole operation is readily visible by east bound traffic on Highway 78. Resol'..1tion No. 138, on December 13, 1959, was approved by the Planning Co:mnu.ssion to allow construction of an asphalt plant, office building, shop building, and relative operations. No conditions were placed on this approval. CUP-9 (Revision). Resolution No. 204, on April 11, 1961, was approved by the Planning Connnission as an amendment to the Conditional Use Permit allowing quarry operations, including two rock crushers and related equipment. Conditions were applied to control dust, to provide potable water, and sanitary sewage disposal. From staff's observation, dust control appears to be adequate. Sewer .1 -- is by septic systems and apparently meets the Cotmty Health Standards. However, water was not provided to the satisfaction of the Fire ~farshall. Water for the plant operation is from a well and surface drinking water is bottled. The Fire Marshall has indicated that there is not sufficient water on the site to control fires. Following Plarming Conunission approval, the item was appealed to the City Cotmcil by the neighboring property owners. The Cotmcil upheld the approval but added several more conditions which included: No quarry operations below creek level; a requirement to notice Tri-City Hospital before blasting, and provide proof of liability insurance. The matter was referred back to the Planning Conunission for concurrence, and then approved by Cotmcil on Jtme 6, 1961, Resolution No. 737. CUP-9(A). Resolution No. 1429. On January 11, 1978, the Plarming Conunission approved an amendment to the Conditional Use Permit allowing a temporary trailer for use as an employee ltmchroom on the South Coast Asphalt property. Conditions applied to location, use, and the temporary status of the ltmchroom trailer. A final condition required the removal of a second mobile tmit operating on the site. This other mobile tmi t is the Brown Trucking trailer, which was moved to its present location, still on the South Coast Asphalt property. Environmental Impact Information The request for the temporary trailer meets the requirements of the Carlsbad Environmental Protection Ordinance because a negative declaration has been issued for the following reasons: 1) The project will not affect vegetation or wildlife, as the area has been previously graded. 2) The trailer will be located at an existing trucking operation and will have no significant visual impact on the area. General Plan Information The Land Use Element of the General Plan indicates residential low-medium density (RIM). The area is also designated for special treatment as it is used for rock and mineral extraction. The General Plan states that particular care should be utilized when considering adjoining land uses that may be incompatible with extraction operations. Public Facilities Public sewer and potable services do not exist at the site. Sewer to the property is served by septic tank; water by well and bottled water. Brown Trucking employees use lavatory facilities at the office of South Coast Asphalt. These facilities, while on the site, are a considerable distance from the present location of the Brown Trucking trailer, and not available to the employees during all hours of operation. Major Plarming Considerations 1. Will approval of a temporary trailer have any detrimental effects on nearby properties, or cause a fire or safety problem? .2 ----- 2. Is the requested use in hannony with the various elements and objectives of the General Plan? 3. Is the site for the intended use adequate in size and shape to accommodate the use? 4. Are facilities adequate to service the site and the intended use? .3 .-..
