I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4922 APPROVING the Negative Declaration and Addendum issued by the Planning Director and ADOPT Planning Commission Resolutions No. 4923 and 4924 APPROVING CUP 154(D) and HDP 01-01 based on the findings and subject to the conditions contained therein. II. INTRODUCTION This application is a request for a Conditional Use Permit (CUP) and a Hillside Development Permit (HDP) to allow Pacific Bell to construct a two-story, 36 foot high, 14,710 square foot addition to an existing electronic telephone switching facility. Telephone electronic switching facilities are permitted in the Planned Industrial (PM) Zone subject to a CUP as provided for in Section 21.42.010(2)(1) of the Carlsbad Municipal Code. III. PROJECT DESCRIPTION AND BACKGROUND The proposed Conditional Use Permit Amendment is requested to expand the existing Pacific Bell owned electronic switching facility. The site is located on the south side of Camino Vida Roble just west of Yarrow Drive in the Palomar Airport Business Park. The project site is surrounded by developed properties containing planned industrial uses. The site is located within the Airport Influence Area of McClellan-Palomar Airport atid is consistent with the Comprehensive Land Use Plan (CLUP) for the Airport. In 1978, the applicant processed a Conditional Use Permit (CUP 154) to legitimize the existing use and to expand the existing structure. The CUP was approved permitting the telephone electronic switching facility in the PM Zone and allowing the 1,570 square foot expansion of the existing building for a total square footage of approximately 6,730 square feet. In 1994, Pacific Bell processed two amendments to their Conditional Use Permit: 1) to legitimize an additional unapproved expansion (CUP 154(A)); and 2) to permit the temporary storage and impound of seized vehicles (CUP 154(B)), which has since been removed. CUP 154(C) was a request to construct a two-story, 36-foot high, 17,487 square foot expansion of the existing single-story structure, which was approved August 6, 1996 and would have expired on August 7, 2006. Planning Commission has approved the Conditional Use Permit and all of the amendments. 0 CUP 154(0)/HDP 01-01 -PACIFIC BELL February 21, 2001 Page2 The proposed two-story addition is to the south and behind the existing building. The building will be beige in color with maroon accent treatments to match the existing building. Other improvements consist of minor redesign changes to the drive entrance, the existing parking area to accommodate the expansion, and related landscape changes. A retaining wall along the southern property line is proposed to make room for the expansion. The retaining wall will cut into an existing manufactured landscaped 21-foot tall slope and is proposed to be a maximum of 12.5 feet tall at its highest point at the southeasterly portion of the site and slope down to about 6 feet in the southwesterly portion of the site. A total of 1,000 cubic yards of earthen material will be exported from the site. The HDP is required for the retaining wall to be built into the slope. The building expansion is necessary to accommodate additional telephone electronic switching equipment to serve Carlsbad. The building addition will increase the employee population from four to seven employees at this location. The applicable and appropriate General Plan MEIR Mitigation conditions for Circulation and Air Quality have been included in the design of this project. The telephone electronic switching facility is served by the existing fully improved streets, including sidewalks on a portion of the north side of Camino Vida Roble; has been designed with north facing translucent light-diffusing windows to improve building energy efficiency; and has been designed with solid grouted walls, insulated concrete roof tiles and layered insulation boards on the roof to reduce energy needs to cool the building. The requested building expansion for the telephone electronic switching facility will be constructed by Pacific Bell at a considerable expense. As noted earlier, the facility is necessary to provided telephone service to Carlsbad residents and businesses. Consistent with the prior CUP approval for Pacific Bell, it is recommended that the CUP be granted for a period of 10 years to be extended in the future for a period of up to 10 years. This project is subject to the following regulations: A. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); B. Hillside Development Regulations (Chapter 21,95 of the Carlsbad Municipal Code); C. Comprehensive Land Use Plan for McClellan-Palomar Airport; and D. Growth Management. IV. ANALYSIS A. Conditional Use Permit Regulations Chapter 21.42 of the Carlsbad Municipal Code requires that four findings be made in order to approve a Conditional Use Permit. All of these findings can be made for this project as discussed below: Findings required to grant a Conditional Use Permit 1. Desirability and Harmony of Proposed Use The telephone electronic switching facility is desirable for the benefit of the community. The telephone switching facility makes telephone service available to businesses and residents of the City of Carlsbad. The proposed expansion will service new growth in the City. To ensure that the telephone facility does not CUP 154(0)/HDP 01-01 -l'ACIFIC BELL February 21, 2001 Page 3 impose any detrimental impacts to other uses in the same vicinity, the proposed project has been designed with compatible architecture and enhanced landscaping. The project has been conditioned to maintain all landscaping in a healthy and thriving condition. 2. Adequate Size and Shape The site is adequate in size and shape to accommodate the expanded telephone facility. The project meets or exceeds the development standards of the PM zone and has been designed with adequate setbacks, parking, and has been designed with enhanced landscaping. Only 26% of the site will be covered with a structure. 3. Necessary Features Provided The telephone switching facility already exists on the subject site. The site is fully developed with buildings, fencing, landscaping and paved parking areas. The paved parking areas will be redesigned to accommodate the proposed expansion. The northern 60 feet of the site along Camino Vida Roble, contains mature landscaping which obscures the existing telephone switching facility as viewed from the street. As identified in the table below, the development meets all of the standards of the PM Zone. The existing building is a single-and two-story, 23,332 square foot structure. The proposed addition is a two-story expansion to the south, or behind the existing two-story building. The new expansion will be painted beige to match the existing structure. The new structure has been designed with features such as painted metal louvers and painted trim to match the existing building. An existing second-story outdoor patio and an at-grade outdoor patio eating area are provided for employee use. The proposed overall building height is 36 feet. As provided for in Section 21.46.020, building features such as parapet walls may be erected above the building height. The actual roof height is 35 feet, which complies with the height requirement of the PM zone. Adequate Street System The traffic impacts of the telephone switching facility amount to approximately 32 trips per day, which is insignificant. The number of additional vehicle trips generated by this expansion will not increase significantly over the existing approved project as the number of employees will increase from four to seven employees with this expansion. The expanded building will be completely occupied by new equipment. The street system is adequate to handle this minor traffic generation. B. Hillside Development Regulations No development of slopes with more than a fifteen percent gradient and elevation differential greater than fifteen feet may occur without first obtaining a hillside development permit. The slopes on the property, located on the southerly end of the lot, are a maximum of 21 feet tall, as measured to the property line, and have a slope gradient of up to 43 percent. The slopes were created during the mass grading of the industrial subdivision and are presently landscaped. A retaining wall is proposed along the southerly end of the lot to gain additional building area for the proposed building expansion. A narrow (15') space between the building and proposed retaining wall is to allow for vehicular and maintenance equipment access to the southern end of the building. The project proposes to export 1,000 cubic yards of material. The two acre site will result in 500 cubic yards per acre of grading volume where Oto 7,000 cubic yards per acre is determined to be acceptable. The maximum wall height proposed is 12.5 feet and is located in the southeasterly comer of the lot. The wall height averages eight feet along the southerly end of the property with the highest point being 12.5 and the lowest being 5.8 feet tall within the slopes that qualify as hillside slopes (> 15' height and> 15% slope). The maximum retaining wall height allowed for manufactured uphill perimeter slopes with gradients over 40% is six feet. A modification to the development and design standards may be approved if the Planning Commission finds that the proposed development complies with the purpose and intent provisions of Section 21.95.010 and makes one or more of the following findings: the proposed modification will result in significantly more open space or undisturbed area than would strict adherence to the HOP requirements; and the proposed modifications will result in the development of manufactured slopes which are more aesthetically pleasing and natural appearing than would strict adherence to the HOP requirements. The purpose and intent of the hillside section is to: A. Implement the goals and objectives of the land use and open space/conservation elements of the Carlsbad General Plan. B. Assure hillside conditions are properly identified and incorporated into the planning process. C. Preserve and/or enhance the aesthetic qualities of natural hillsides and manufactured slopes ... which are located in highly visible public locations. D. Assure that the alteration of natural hillside will be done in an environmentally sensitive manner. CUP 154(D)/HDP 01-01 -PACIFIC BELL February 21, 2001 Page 5 Because the slopes on the property are not highly visible from a public place, not constrained by special environmental or cultural resources or provide buffers to native areas, the development of the slopes would not bias the implementation of the open space/conservation elements of the General Plan. The proposed retaining wall would not preclude the development of an industrial base of light, pollution free industries, which is a goal of the Land Use Element of the General Plan. The applicant has provided adequate information on the development plans to identify the slopes on the property. The development of the slopes has been considered during the review and design of the project. Because of the long rectangular shape of the lot, the proposed retammg wall is located approximately 350 feet from the public right-of-way and is not considered to be highly visible. The retaining wall will be predominantly screened from public view by the proposed building expansion. Adjacent properties to the south and east are built on pads that are higher than the subject site and the building to the west are built slightly above and north of the wall location and would not have significant views of the proposed retaining wall. As noted above, the existing landscaped slope does not contain any sensitive flora or fauna and disturbance to the slope would not affect any other natural resources. To mitigate the impact of the over-height retaining wall, the project proposes to increase the front yard building setback by an amount greater than the amount of slope area removed. The building setback along Camino Vida Roble will be increased from 50 feet to 65 feet thus resulting in more open space on the lot. This open space will be a greater benefit to the public as any future development of the site will be placed further back on the property, which will increase the potential for landscaping and less emphasis on the buildings. C. Comprehensive Land Use Plan for McClellan-Palomar Airport The proposed project is located within the Airport Influence Area, but is located outside of the 60-dBA CNEL noise contours. The project site is not located within either the Runway Protection Zone (RPZ) or Flight Activity Zone (FAZ). The Comprehensive Land Use Plan (CLUP) for McClellan-Palomar Airport only addresses uses impacted by noise levels above 60 dBA CNEL or properties located within the RPZ or FAZ. As such, the proposed use is consistent with the McClellan-Palomar Airport CLUP. D. Growth Management The project site is located within Local Facilities Management Zone 5 in the southwest quadrant of the City. ENVIRONMENTAL REVIEW COMPLIANCE The site was previously mass-graded and padded-out as a part of the Palomar Airport Business Park development. The site is fully developed with buildings, asphalt and landscaping. Staff has determined that no significant adverse environmental impacts will result due to this project. The Planning Director, therefore, issued a Negative Declaration on October 31, 2000. Subsequent to the issuance of the Negative Declaration, it was determined that the projects grading and retaining wall improvements required the processing of a Hillside Development Permit. The project's Negative Declaration included the review of the grading and retaining wall but not the permit requirement. This addendum does not require the Negative Declaration to be re-circulated for public review because it does not constitute a substantial revision according to California Environmental Quality Act Guideline 15073.5.
