HomeMy WebLinkAboutCD 2024-0002; PLAZA PASEO REAL; Admin Decision LetterFebruary 20, 2024 Russel Rosales KTGY 17911 Von Karman Ave., Ste. 200 Irvine, CA 92614 SUBJECT: CD 2024-0002 (DEV2017-0162)-PLAZA PASEO REAL ( Cicyof Carlsbad The City Planner has completed a review of your application for a Consistency Determination, CD 2024- 0002, which is a request to review the proposed project's compliance with Site Development Plan SDP 86- ll(A) for the Plaza Paseo Real shopping center located at 6951 El Camino Real (APN 215-050-76). The proposed project entails a request to expand an outdoor dining area, originally approved as part of CD 2022-0005, on the upper level of the Plaza Paseo Real shopping center, from 400 square feet to 631 square feet. As a result of the expansion, three additional parking stalls are required. After careful consideration of the request, the City Planner has determined that the request meets all the findings below and APPROVES this request. For a Discretionary Permit Consistency Determination to be approved, each of the following findings must be made: 1} No project condition, feature, facility, or amenity is changed or deleted that had been considered essential to the project's design, quality, safety, or function in that the expansion to the outdoor dining area from 400 to 631 square feet is consistent with SDP 86-11(A). Specifically, the expanded outdoor dining area on the upper level of the shopping center requires three additional parking stalls. A surplus of 125 parking spaces currently exists for the shopping center. As a result of the expansion to the outdoor dining area, a surplus of 122 parking stalls will remain. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that adequate parking remains for the Plaza Paseo Real shopping center. 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit in that the project entails an expansion to an outdoor dining area for a commercial tenant located on the upper level of the Plaza Paseo Real shopping center. 5) The proposed revision does not rearrange the major land uses within the development. 6) The proposed revision does not create changes of greater than ten percent if compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that the requirement for three additional parking stalls represents less than a ten percent change in the existing number of parking stalls in the shopping center and a surplus of 122 parking stalls remains. B) The proposed change would not result in any health, safety, or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that the expansion to the outdoor dining area is consistent with SDP 86-ll(A). Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35. This decision may be appealed by you or any other member of the public to the Planning Commission within ten days of the date of this letter. Appeals must be submitted in writing to the Planning Division at 1635 Faraday Avenue in Carlsbad, along with a payment of $900. The filing of such appeal within such time limit shall stay the effective date of the order of the City Planner until such time as a final decision on the appeal is reached.
