I. PROJECT DESCRIPTION AND BACKGROUND The applicant is proposing to construct 11 duplex units totaling 22 units on 12.36 acre parcel located as previously described. Most of the property consists of sloping land covered with native vegetation, however, the southwesterly third of ·the property has been previously graded and is devoid of any native vegetation. A large single family dwelling is located on the scuthwesterly portion of the property. In the past, this building was utilized as ~n office and heavy _ equipment was stored on the property. The house is being use_d as a sinqle family residence at the present time. The properti2s to the east, south and west are vacant, while the property to the north is being utilized for agricultural purposes and has an agricultural par.::king_ plant on it. As shown on Exhibit "A", the 11 duplexes will be located along a circular drive surrouding the existing residence. This existing residence will. serve as the manager's living quarters as well as a fellowship hall. One of the proposed duplex units will have no bathroom or kitchen facilities and will be used as a storage facility. Another of the duplexes will contain a nurses quarters and limited medical facilities. The remaining 9 duplexes will be used as rent free residences for retired Sudanese mis~ionaries. As the Planning Com.mission will recall, the subject property is in the process of being annexed into the city and the Commission rezoned the property from County S-90 to R-1-10,000(Q) on September 10, 1980. The Q overlay zone requires the approval of a site development plan by the Planning Commission. Since a conditional use permit is required for a religiously oriented facility in a residential zone and it accomplishes the same purpose as a site developr,1ent plan, a separate site develop~ent plan was not required to be.submitted by the applicant. II. ANALYSIS Planning Issues 1. Is the site suitable for the proposed use? 2. What public improvements will be needed to adequately serve the project? 3. Can the mandatory findings for granting a conditional use permit be made? III. DISCUSSION When completed the proposed project ~ill have a density of 1.6 du/acre which is consistent with the General Plan designation of 0-4 du/acre for this site. As shown on Exhibit "A", only a third of the site will be occupied by the dwelling units and the access road. The applicant proposes to plant an orchard in' the eastern third of the property while the remaining portion will be left in its natural state. • ' When this plan was originally submitted, staff had concerns about the isolation of the proposed .site and the distance to • the nearest public services and amenities. The applicant has indicated, however, that the pe0ple who will live at this project h,-.ve spent most of their lives in remote sections of Africa and are accustomed to living in isolated areas. Also, the low level of density being proposed should reduce public service problems. As part of ·the tentative tract map approval, staff is recommending that the applicant be required to provide the necessary street improvements to serve this proje~t. Laurel Tree Road and the off-site street connecting Laurel Tree ·Road and the subject property (presently an easement road) is recommended to be paved to a minimum width of 28 feet to city standards to allow for two lanes of traffic. The private streets on the subject property are recommended to be paved a minimum of 24 feet wide. As proposed the pro'ject meets ail of the requirements for the issuance of a conditional use permit. Specifically, the requested use is essentially in harmony with the various clements and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in ·which the proposed use is to be located; the site is adequate in size and shape to accommodate the use, and as conditioned, the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. -2- The Airport Land Use Commis·sion has indicated that this propos_ed development is located within the influence area of ·Palomar Airport. Although the devlopment is presently compatible with the adopted land use plan for the airport, the plan is presently being updated and new noise information and regulations must be incorporated into the updated plan. It is possible that the new plan will indicate that the subject development is located within an area adversely impacted by noise from the airport. The applicant has been made aware of this and staff is recommending as a condition of approval that should the updated plan indicate that the subject property is in a noise impact area, the applicant will ·grant appropriate easements or execute appropriate agreements so that the city and the airport will not be held responsible for airport-related noise impacts. -IV. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a significant impact on the environmant and therefore has issued a negative declaration on November 19, 1980. V. RECOMMENDATION It is recommended that the Planning Commission APPROVE the Negative Declaration issued by the Planning Director, and adopt Resolution No. 1740, recomrnend;i.ng APPROVA!.. of CT 80-44 and Resolution No. 1741, APPROVING CUP-190, based on the findings and subject to the conditions contained therein.
