HomeMy WebLinkAbout1981-02-11; Planning Commission; ; CUP 192 - ECKE/PEA SOUP ANDERSEN WINDMILL TOWERSTAFF REPORT DATE: February 11, 1981 TO: Planning Commission FROM: Planning Department SUBJECT: CUP-192, ECKE, Request for a conditional use permit to construct an 80 foot high windmill as part of the previously approved Anderson's Pea Soup Restaurant and motel complex on the northeast corner of t'alomar Airport Road and Paseo Del Norte in the CT-Q zone. I. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting approval of an 80 foot high windmill as part of the previously approved Pea Soup Anderson's travel center, located as described above. Approximately 10-20% of the electrical power required for the facility will be generated by this windmill. A Site Development Plan for the Pea Soup Anderson travel center was approved by the Planning Commission at their meeting of September 10, 1980 (see attached exhibits). At this meeting, the applicant also requested approval of a height variance to allow an increase of the 35' building height limit of the CT-Q zone to allow the 80' high windmill. At that time, the Planning Commission denied the variance because they could not make all the four mandatory findings required for approval. The Commission did not object to the windmill, however, and directed staff to prepare an amendment to the Zoning Ordinance to provide for windmills which exceed the height limitation. On November 12, 1980, the Planning Commission approved a Zone Code Amendment (ZCA-128) which provided for windmills which exceed the height limit of the underlying zone upon approval of a Conditional Use Permit. Approval was made subject to the finding that the primary purpose of the windmill is to generate usable electrical or mechanical energy and that the windmill is architecturally integrated with the other buildings on the site. Based on this amendment, the applicant is now requesting approval for a Conditional Use Permit to construct the 80 foot high windmill. II. ANALYSIS Planning Issues 1) Is the proposed use desirable for the community and in harmony with the various elements and objectives of the General Plan? 2) Will the proposed use be compatible with other existing and permitted future uses in the vicinity? 3) Is the site for the proposed use adequate in size and shape to accommodate the use? 4) Is the primary purpose of the windmill to generate usable electrical or mechanical energy and is the windmill architecturally integrated with buildings to be placed on the site? III. DISCUSSION As mentioned, the Planning Commission has already reviewed the proposed windmill and has indicated no major problems with it. As shown on the attached exhibits, the proposed windmill is part of a well-designed travel center consisting of a motel, restaurant and related facilities. Further, the windmill is not in conflict with the General Plan. The proposed use will also be compatible with the existing and future permitted uses in the area since most of the surrounding properties have been designated for travel services or commercial development by the General Plan. The Commission has previously reviewed the site plan for this project and has determined that the site for the proposed travel center is adequate in size and shape to accommodate the use and the surrounding street system is adequate to handle all traffic generated by this project. Finally, the windmill will generate 10-20% of the energy for the facility and is architecturally integrated with the other buildings to be placed on the site. Staff feels, therefore, that all the required findings for approval of a Conditional Use Permit can be made. IV. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a significant impact on the environment and, therefore has issued a negative declaration on January 19, 1981. V. RECOMMENDATION It is recommended that the Planning Commission APPROVE the negative declaration issued by the Planning Director and adopt Resolution No. 1765 APPROVING CUP-192, based on the findings and subject to the conditions contained therein.
