NOTICE OF RESTRICTION ON REAL PROPERTY
ACCESSORY DWELLING UNIT
The real property located in the City of Carlsbad, County of San Diego, State of California
described as follows:
Lot 8 of Carlsbad Highlands, in the City of Carlsbad, County of San Diego,
State of California, according to Map thereof No. 2647, filed in the Office of
the County Recorder of San Diego County, April 18, 1950. Excepting
therefrom that portion lying Southerly of a line described as follows:
Beginning at the most Southerly corner of said Lot 8, said corner being also
on the Easterly right of way line of Alder Avenue as shown on said Map,
said right of way line being a 60.00 foot radius curve, concave
Southwesterly; thence Northwesterly along the arc of said curve, through a
central angle of 45°09'26" a distance of 45.19 feet to a point, a radial line
to said point bears North 35°34'44" East and the True Point of Beginning;
thence leaving said curve, North 11 °32'20" East 29.00 feet; thence North
67°40'04" East 64.94 feet; thence North 78°34'1 O" East 304.04 feet to the
most Westerly corner of land described in Deed to Raymond R. Binkley, et
ux, recorded January 2, 1963 as Instrument No. 303, of Official Records;
thence along the Northerly line of said Binkley's Land, North 73"03'22"
East, 76.01 feet to an intersection with the Northeasterly line of said Lot 8
distant thereof North 25"29'00" West, 90.00 feet from the Southeasterly
corner of said Lot 8. Also Excepting therefrom lying within Road Survey No.
1800, as granted to the City of Carlsbad in Deed recorded July 8, 1969 as
Instrument No. 122793, of Official Records.
has been approved for an ACCESSORY DWELLING UNIT by the City of Carlsbad on February
6, 2024. Said approval restricts the property as follows:

per California Government Code Section 65852.2 are binding on all present and future

ACCESSORY DWELLING UNIT is rented, a rental period of less than 30 days is
prohibited. This requirement does not apply to any unit that was issued a building permit
prior to January 1, 2020.
