HomeMy WebLinkAbout2024-03-26; City Council; Resolution 2024-058RESOLUTION NO. 2024-058 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT TO WRIGHT CONSTRUCTION ENGINEERING CORP FOR AN AMOUNT NOT TO EXCEED $2,725,512 AND AUTHORIZING ADDITIONAL APPROPRIATIONS IN THE AMOUNT OF $400,000 FOR THE PARK DRIVE STREET AND DRAINAGE IMPROVEMENTS PROJECT WHEREAS, the City Council of the City of Carlsbad, California, has determined it is necessary, desirable and in the public interest to construct Park Drive Street and Drainage Improvements Project, Capital Improvement Program, Project No. 6611; and WHEREAS, on Feb. 6, 2024, the City Council adopted Resolution No. 2024-018, approving the plans and specifications and authorizing advertisement for construction bids for the project; and WHEREAS, on March 12, 2024, staff received five bids for construction of the project; and WHEREAS, Wright Construction Engineering Corp submitted the lowest responsive and responsible bid to construct the project, in an amount of $2,725,512; and WHEREAS, the current funding from the gas tax and General Capital Construction funds is not sufficient to compete the project; and WHEREAS, additional appropriations in the amount of $400,000 is now required to complete the project; and WHEREAS, Carlsbad Municipal Code, or CMC, Sections 3.28.080(C) and 3.28.080(1)(6), which govern purchasing in construction contracts, require the City Council to award all formally bid contracts when the value exceeds $200,000; therefore, the Project is subject to this requirement; and WHEREAS, CMC Sections 3.28.040(C)(5) and 3.28.090(8) authorize the City Manager or designee to approve change orders in an amount equal to the contingency set at the time of project award, which is $650,000 for the Project; and WHEREAS, the City Planner has determined that the project is in accordance with the California Environmental Quality Act and the CEQA Guidelines, the City Planner approved a mitigated negative declaration (State Clearinghouse No. 2021070586) for this project on March 30, 2022. Mitigation measures were incorporated into the design of the project and included a mitigation monitoring and reporting program so that all potentially significant impacts would be mitigated below a level of significance. follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as l. That the above recitations are true and correct. 2. That the lowest responsible and responsive bid of $2,725,512 submitted by Wright Construction Engineering Corp for construction of the Park Drive Street and Drainage Improvements, CIP Project No. 6611, is accepted, and the Mayor is hereby authorized to execute the contract for the Project. 3. That the City Manager or designee is authorized to appropriate an additional $400,000 to the Park Drive Street and Drainage Improvements Project, Capital Improvement Program Project No. 6611. 4. That the City Manager or designee is authorized to approve construction change orders up to $650,000 for the Project. 5. That the award of this contract is contingent upon Wright Construction Engineering Corp executing the required contract aL)d submitting the required bonds and insurance policies, as described in the contract, within 20 calendar days after adoption of this Resolution. The City Manager may grant reasonable extensions of time to execute the contract and assemble the required bonds and insurance policies.
